Hi CD Frineds,

I purchased a digital camera from Future Shop in July 2004 with an extended warranty for 4 yrs by paying extra $99.99. Camera stopped functioning in Aug this year and could not be repaired by Future Shop. They offered me a replacement camera as per warranty terms but to the tune of only $139.99. As per terms they are either replace the product with a comparable product or can issue a store credit for the ORIGINAL PURCHASE Price at the discretion of store manager.

Guys, the store manager was ready to issue sore credit but again in the amount of only $139.99. She offered a replacement camera of $139.99 value or get a store credit for the same amount. She said that was the current value of camera due to depreciation. She was not ready to listen anything and to honor the terms of original warranty.

Any CD member had such experience any time. Well, I am taking this matter with their Customer Service.

Jain Saheb,
What the store manager said must have been the fine print of the warrenty terms. She canot lie to you or twist the warrenty terms b'cos you could sue Future shop. I would recommend you to again study the Warrenty conditions in full.
If the store manager said that she can give you only $140 then it means that she knows the rules and that she has no need to give you anything above $140. However, if you speak to her nicely/politely and show a sorry state of affairs at your end, she may at her discretion give you the current rate.
One of my friend had the same experience with a desk top computer. Calls to the Customer service did not yeild any result. The person wrote an e-mail to the Labour ministry (or a similar ministry related to this) and the minister in carge of the ministry spoke to Future shop manager. After this the Future shop manager called my friend and told him that they were ready to give him a brand new computer which he got.
All this took around 4-6 weeks and he was unemployed at that time, alloing him to follow up relentlessly.
Just the experience of my friend.

Sidenote : You have not indicated as to how much you paid for the Digital camera. The price would enable us to determine as to how much , FS guys are trying to rip you off (a consumer)

I too had this issue of reduced replacement. I had to talk to the manager over there and managed to get new unit with a bit more additional features but comparable in other aspects. I would suggest not to get a store credit as the refunds might not get you a new product with some additional features which you may want now.

Hi Tamilkuravan

I had read the fine prints several times and I am 100% correct in my understanding. I bought this camera in $399.99 + tax. I can go for a comparable camera with the same features or even can pay more for increased features. But I certainely can not accept her offer for a camera costing $139.99 or a store credit of the same amount.

My idea of geting the store credit was just put some more money and to buy something with latest technology and improved features.

If you believe that your demands are in tune -

You have an option to go to Consumer Service Bureau ...
http://www.gov.on.ca/MGS/en/ConsProt/050451.html

Ask her to put it in writing ... take to Bureau and launch complaint
http://www.gov.on.ca/MGS/en/ConsProt/STEL02_045912.html

I have not gone thr' site completely, but ofcourse so far not needed to do so.

Hope it helps ... Share your experience if you opt to go through this route.

The amount $399.99 is probably including the $99.99 PSP.

But the manager is right and as per the PSP term, they will replace the defective with a new product with 'equivalent' or 'better' features for the price it sells currently. Obviously, since the product is 2 yrs old, it will have no current price in the shop, hence you need to compare with an equivalent feature product.

You need to look at it in different perspective - as a customer, after 2 years you are getting $140.00 for a non functioning camera. Besides depreciation and price drop which is typical of ALL electronic products, you should also weigh in the useful life you enjoyed with the product.

I am not trying to defend the PSP or future shop, but just taking a practical view of the situation. Legally, you have the right to demand compensation, but personally I dont think it will take you anywhere.

You can go back, select a good product without involving the manager (as if you are buying fresh), negotiate the best price and then call the manager to give you further discount for the hardship you faced with the old product. Pay with the credit you get for the returned product and top up the balance. Always show willingness to buy another PSP in the new product, if you are given a discount on the main product. Whether you do invest in the new PSP is altogether your decision based on your experience with customer service and the manager.

I know it is very annoying and difficult to digest, but take heart from the fact that atleast such options are available here compared to sales in other non-branded stores or even in our native countries - where there is no return policy at all - once the payment is made, its all your luck.

All the best.
Hiren
