I wish to file for my green card once I start working from Oct 1 st 2007.In the post July 2007 scenario where all EB categories have been made current what is the process for the new petitioners who will be filing for their green cards.
I am assuming that there should be no issues with my labor certification as I have the relevant education and work experience in US & Canada.
Is the INS accepting I 140s at this stage from new petitioners ?

What post July scenario? State Dept has done an about face and retracted all the numbers claiming all the visa numbers have been used. Everyone has to wait till next fiscal year starting Oct 2007.

Nothing changes in the processing until there is a explicit law that says so. You still have to file for labor which could be processed through the new system of PERM which supposedly is claimed to be ultra fast.
Only after the approval of labor, can the 140 be filed. And only if the priority date is current for you, then 140 and 485 can be filed simultaneously. If not, you can file only the 140.
Your qualifications and experience is relevant to what the job and employer requires and not necessarily based on what you have. You could hold a Phd and if the job requires only a bachelors, that's how your petition would be evaluated.
