Surrender Certificate Issue?

HI All,

I have gone through lots of forum and i would require more information on it?.

I have aquire canadian citizenship in 2006 and valid indian passport exp date:2017.

I want surrender certificate and they told me it cost me $240/ penalty and $20 fees and HST total $281.

This penalty has been implemented by consulate general of canada.

1)Do you know any way to oppose this injustic? any petition? Any success case with argument with consulate general. Please advice?

2) I have been travel to india on Canadian Passport in May 2007/Jan2009/may 2010.
They have npt asked me about it and i have not been informed about it?.

How would i know that there is a rule like this?. I am not a big fan of news either.

So please let me know any way to fight with this?

This is complete injustic?

If you have travelled to India on Canadian Passport then you must have got the travel visa. Right? Or did you travel to India on Indian Passport and while coming back used your Canadian Passport. If the latter is true then you have to pay $240.

If you have got visa, then your passport would have been stamped as cancelled. Then in that case you do not need Surrender Certifficate.

I have never used Indian Passport after receiving the Canadian Citizenship. Whne i took visa in 2007/2009, I send my canadian passport to indian embbasy -toronto and obtain visa in 2010 i approached VFS global and obtain visa.
On all of three occassion they never asked me for my indian passport.

So in this senario how come somebody will ask me to pay the penalty without communicating to the people.

Curious case indeed.
The rule is that when applying for Indian visa first time, you need to submit your latest Indian passport.
They cancel it at that time, and thus the applicant does not require surrender certificate in future.
I am surprised that Indian consulate did not ask for your Indian passport the first time you applied for the visa.

Call the Indian Consulate in Toronto and speak to them directly about this.
Since you have not violated the rule of traveling to India with Indian passport after acquiring citizenship, you should not be subject to the penalty.

Indian high commission will ask your passport first time when they give the visa. If you have a visa stamp on your canadian passport, they will not ask for Indian passport again and again. I think they may have forgotten to cancel the passport the first time. In that case, you can approach Indian High Commission directly (in person) and take up your case. VFS will repeat what they have been told to them. They will not make any decision even if it was Indian High Commission fault at first instance.

Don't say how....it is a government department...they do not make mistakes...and especially if it belongs to Government of India which works more on Egoism than the rules....

Good luck with your call. It is similar to calling Bhagam Ram in Ayodhya. You may be able to connect to Ram than CGI.

There is no injustice, if you go and talk and resolve the issue.
