Two sides keen to ensure incident does not affect ties
The New Delhi-Rome standoff over the killing of two Indian fishermen off the Kerala coast is not over yet with the detention of two marksmen, although the two sides are trying to isolate the incident from their “multi-faceted'' bilateral ties.

Besides engaging diplomatically, Italy is working the Catholic channels via the Vatican to allow the two marines to leave for Rome after paying some compensation to the families of the killed fishermen. “But India is firm. Their case will be investigated here. And then, unless the courts decide otherwise, they should be tried here,” said highly placed sources, while disputing all the three legal approaches Italy is taking to secure the release of its two citizens.

The Italian Deputy Foreign Affairs Minister will meet his counterpart Perneet Kaur on Wednesday and the Foreign Minister arrives next week on a prescheduled visit to convince New Delhi that any of their nationals involved in criminal activity anywhere are subject to Italian law.

“This is their main approach,” said the sources while pointing out that Section 4 of the Indian Penal Code says that any crime committed against an Indian or on an Indian vessel “wherever it may be'' can be tried in India.

“So there is extra-territorial application of both Indian and Italian laws. As representatives of India, we will go by the legal process here. There are differences with Italy on facts, procedure and processes but we are willing to engage with them. If they so desire, we will provide consular access to the two detained by the Kerala Police,'' said official sources.

The second approach Italy is taking is to argue that the UN Convention on the Law of the Sea (UNCLOS) permits prosecution only by the state whose flag the ship is flying or the state of which the citizen is a national (in both cases Italy). The third is that their ships have the right to take on pirates.

“We think Italy is overdoing this. According to us, Article 97 of UNCLOS to which they are referring deals only with collision of vessels and other such incidents. Italy also feels it has the right to take action against pirates. In this too they are in the wrong. This right is given only to naval vessels and not merchant ships,'' said highly placed sources, basing their explanation on the advice given by the MEA's legal cell.

Officials here also confessed that both sides are facing an issue like this for the first time.

Asked if there were precedents of this nature, official sources pointed out that an Indian fishing vessel was attacked by nationals of another country in 2008 and “we know what happened after that in Mumbai.''

They also felt whether the ship was in India's exclusive economic zone (EEZ) or not shouldn't be an issue. “Italy and India have the same clauses pertaining to extra-territorial jurisdiction. The ship was over 5,000 km away from the Italian coast. Don't make an issue of the EEZ aspect.''

“Our goal is to isolate this incident. That's why we explained the legal framework on Sunday to the Italian delegation. Besides law and order is a state subject,” added the sources.

Now PM HIMSELF CONFIRMS HOW foreign sources have used religious route to stop a project which will advance India.

If USA , Europe and Saudi Arabia can influence India's internal affairs without sending a person over or firing a bullet what is the use of being a secular democracy?.

Our neighbor can send 25 persons by boat and play havoc with our financial capital or china can use the communist parties to have bandh and hartals and stop normal life in India without sending a single soldier over.

India's enemy is it's own people.

Even as PMANE, the principal body against the nuclear power plant cries foul in the Prime Minister’s claim, Minister V. Narayanaswamy has a Home Ministry inquiry report to back the claim
Prime Minister Manmohan Singh’s charge that foreign NGOs were stoking protests at the Kudankulam nuclear plant triggered a row, with the Home Ministry endorsing the claim and activists spearheading the stir dismissing it as “baseless”. BJP demanded that facts on the “very important” statement by Dr. Singh be made public.

The statement by Dr. Singh was endorsed by Congress which said it was given on the basis of the reports given by the intelligence agencies. “Party supports his statement”, Congress spokesman Rashid Alvi said in New Delhi.

“Foreign NGOs behind protests”

Minister for State in the PMO V. Narayanasamy said three NGOs were found to be diverting foreign funds for the anti-nuclear campaign in Kudankulam and their licences cancelled.

The cancellation followed a Home Ministry inquiry that the NGOs were using funds meant for social causes to fuel the protests, he said.

Mr. Narayanasamy said the government had taken action after it found that some NGOs, receiving funds from the U.S. and Scandinavian countries, were spending huge amounts of money on the agitation.

“These NGOs were receiving funds from foreign countries for social service causes like helping the physically handicapped and eradication of leprosy but these were used for anti-nuclear protests,” he told PTI.

“In fact, the people who are agitating near the plant have been continuing their agitation for the past three months. People are being brought there in trucks from various villages, they are being given food,” he claimed.

Mr. Narayanasamy said three NGOs were found to be violating the FCRA guidelines by not using the funds for the cause they were received for.

He said the Prime Minister’s observation on anti-nuclear activists using foreign funds came from the inquiry.

PMANE rejects remark

People’s Movement Against Nuclear Energy (PMANE) spearheading the stir against Koodankulam rejected as baseless Dr. Singh’s remark. The commissioning of the plant in Tirunelveli district has been stalled due to the protests.

“It is unfortunate that the Prime Minister has made the allegations without any documentary proof. We strongly deny his observation that the agitation is being funded by other countries,” S.P. Udayakumar told reporters in Chennai.

Mr. Udayakumar demanded that Dr. Singh provide documentary proof in support of his allegation or withdraw his remarks.

Make details public: BJP

BJP leader and Leader of Opposition in Rajya Sabha Arun Jaitley asked the government to make public the details of the alleged protest-funding NGOs.

“It is a very important statement that the Prime Minister has made. Therefore, since he has made a statement, I think the government must make facts in regard to this public so that the veracity of all this is known to people of India who are in a position then to decide what is the correct position,” Mr. Jaitley said.

CPI leader D. Raja alleged that the prime minister was trying to isolate some of the NGOs who are working among the local people in Kudankulam.

Kakodkar supports PM

Former Atomic Energy Commission Chief Dr Anil Kakodkar shared Dr. Singh’s sentiments, saying “a nuclear power plant cannot be put under a siege the way it has happened now.”

Mr. Kakodkar said it is strange that a large project ready for implementation which has met all safety requirements, even environmental and when there is tremendous shortage of electricity the country’s developmetn should become “hostage” to such foreign forces.

“By just exploiting the Fukushima sentiment this entire thing has been built up,” he said, adding ” a nuclear power plant cannot be put under a siege the way it has happened now.”

The Prime Minister in an interview to the Science journal criticised non-governmental organisations that received support from abroad for leading protests against the nuclear plant.

Then, referring to the protests at Kudankulam, he said, “the atomic energy programme has got into difficulties because these NGOs, mostly I think based in the United States, don’t appreciate need for our country to increase the energy .
