MK if you have your tickets to India than there is no problem in postponing the date . Just go to court and the clerk will move the date . Its pretty easy

Edit : Above response is true only in case of court date ( not early resolution )

Early resolution is only a meeting with the prosecutor to offer you a deal - but you are still guilty.

Going to trial has 50% chances of having the ticket dropped - early resolution is 100% loss (except may be reduction in amount). The early resolution date can be easily changed (even preponed if you are interested) by visiting the prosecutor's office and requesting a new date. The court is not involved yet.

Remember - when they have more evidence and witnesses, it is increasing your chances of dropping the ticket since it gives you more options to defend and they have too many things to prove.

thansk guys,

The reason i opted for early resolution is to what kind of deal they are going provide sighting my clean record.
As this will be my first ticket under HTA, i wanted to see the evidence of webcam and decide whether i really stopped or did rolling stop.
But after reading thru the links and other forums, i guess i might not able to review the evidence during early resolution meeting and might not even get reduce in points other than reduction in amount.

Does any one had experience of reducing the points or point less fine during early resolution??

I really cannot afford to go for trial with loss of pay unless there is a more than 50% chance, which in my case i highly doubt if they have video evidence...

Go For trial or u want clean record there are many who can fight for you but will cost you... result will be 90% in your favor

1. There is no harm in attending the early resolution meeting - just attend with a plan. Your plan is you are not guilty and wish to review what evidence they have and if they are willing to provide you copy. You don't have to accept anything over there and refuse their offer that is anything other than dropping the charges. This meeting will help you in future when you apply for having the case dropped under chapter 11(b) for taking too long to come to trial.

2. Points or point less conviction is still a conviction and it will stay on your driving record for 7 years though the insurance will review it only for 3 years.

3. What you can afford is your personal decision, there are paralegals for a fee - though I haven't seen any one doing a spectacular job yet.

Never go for early resolution. It is useless. You will never be able to remove conviction from your record. Go straight for the trial. You will get a better deal there.
