Landlord not giving back the deposit

We moved to a new basement this month stayed there for just 2 weeks. We vacated that place for various reasons like not having proper locks for the windows, broken windows, the other tenant who lives upstairs smokes and the smell comes to our basement through the heating air vents etc. Now the landlord is not giving back our deposit. He dont say any reason for that too. We didn't sign a rental agreement yet as he said at that time he is too busy for paper works and will have it later on.
Is there any way to get the money back from him

Timbaktoo rental laws are lenient . BTW did you not check the place for locks , broken windows etc before you moved in ? Smoking is an issue that is difficult to predict before you move in but I guess that's a risk you take. If you have no agreement in place than you are very much on LL mercy.

Report to CRA. Most likely landlord is not paying taxes.

Did you pay by cheque or cash? How much is the amount involved?


There is not much you can do.. if you paid by cheque, you can file a case in small case court, but that is more expenses and without any documentation it will be his word against your. Even if the judgment is in your favor, getting it enforced is another uphill task. Just more pain to you and the aggravation.


In most probability, you have to chalk it up to experience and forget about the deposit.

it was arranged by my friend who is he dont care such things. i saw the the place when i moved in

yes he is not paying taxes. i told him that i will report to canada revenue agency and he lis little bit upset. BTW i live i surrey near vancouver

We paid cash. it is $800. I have recorded our phone conversation admitting that he hs the deposit with him and he dont want to give that back.
