I was wondering if there is an immigration expert familiar with the current caregiver program who could provide some guidance.
My parents were in the middle of the process of sponsoring a caregiver for my Dad, who was dying of cancer.
The LMIA was approved and visa in process
Sadly, my Dad passed away in November
My family notified the agency that they were using, but the process was already in motion; we just found out that the woman they were going to hire received her visa just last week. However since my Dad has passed, there is no longer that job for her with my parents.
That said, I just had a baby in August and need a caregiver when I go back to work in April. Can I hire the person who was approved for my Dad and just bring her over, or is that not allowed? Do i have to start from scratch with a new LMIA application?
Any insight would be helpful.
We have to know a lot of the facts in the case.
1) Who sponsored and paid for the Caregiver's sponsorship?
2) Which location s/he will be working?
3) Are the conditions the same. The workload the same or similar?
4) Wage and other benefits the same?
5) Is the caregiver also agreeable to the changes and will work for the wages agreed?
If so, I do not see any problems arising. Please verify with the Immigration Department.
