TN Status




I am planning to apply for the TN status for a Controller role in US under the accountant category of trade NAFTA professionals. Reaching out to see if anyone has applied under the same category. My questions are:

1. How was Controller role perceived under the accountant category by CBP?.
2. Is the TN status issued for 1 year or 3 years?.
3. I have a bachelors degree in business from USA as well as 15 years experience in the field.

Under the recently announced NAFTA preferences, Canada wants cross border movement of professionals eased. However, Trump administration is filled with immigration hardliners who are working behind the scenes to Throttle the flow of foreign guest workers under all categories into the United States, in any which way they can. Multiple court cases targeting H4 EAD (Spouse Visa), OPT and STEM OPT (Graduate Work Visas) and Entrepreneur Visas are making their way through the US courts. The premise and common denominator behind these court cases is that congressional caps on work visa authorisation have been bypassed using various schemes like H4-EAD. TN Visas, OPT/STEM OPT, H1/L1 Visas. The hardliners want to shut down all these peripheral bypass roads to work authorization in the United States. All indications are that Trump administration will announce significant immigration reforms towards the end of 2017 to force American employers to hire Americans first. So, try and get in before the new rules get in to the books.

People who are PR in Canada and in Mexico are not permitted entry with TN VISA. Also those who are Citizens of these countries, should keep in mind that as a TN, you must establish what is called "non-immigrant intent." This means that you must show the U.S. immigration authorities that you do not intend to stay in the U.S. permanently and that you will eventually return to your home country. (Also you know that you can stay there indefinitely too.)

If you are a Mexican or Canadian citizen, TN status can be an ideal means of legally entering and working in the United States. Current U.S. laws and regulations say that Mexican and Canadian citizens can stay in the U.S. in TN status for periods up to three years. Even better, TN workers are supposed to be able to extend their stays indefinitely, in three-year increments, so long as they satisfy the requirements under the TN program.

The reality, of course, is a bit less rosy. The actual amount of time you can stay and work in the U.S. as a TN depends on a few key factors. Lets look at what can affect your TN status. Please see below..:
