Just one question. the cost of h1 thesedays is not what it used to be.
when you sponsor candidates for H1, who bears that cost?

You have a valid point here.The cost has to be borne by the consultant.But we will reimburse it after one year.let me be frank here.we had consultants whom we sponsored H-1's before free of charge and couple of them ditched us.they kept us in the dark and joined someone after landing in US.it was Ok at that time since the fee was very less, but now after this fee hike we cannot take a chance.

how can someone ditch you after landing in US ? they are only allowed to work for your company upon landing in US.

The stories of shady recruiting agencies are these days more common than the story you mentioned.

Hi Dan,
There are always two sides of the coin.
small example:-2 consultants who were in india been in contact with us while we were in india requested us to file their H-1B narrating stories like they have been duped by someone and promised to work for us.Keeping in good faith and after hearing their sorry tales i was convinced to file their H-1B with company bearing all the costs and subsequently thier visa's were stamped.the day they got visa,they called me to thank me and said that they will be landing in a month as they have preparations to make.Two months passed and i dint hear any word from them and i tried to contact them but in vain.I called all the numbers they gave me of emergency contacts but of no avail.I lost hope .After 8 months i went to the party of a very close friend where we were just discussing about our businesses since most of us belong to same Consulting business.i casually narrated the story and one guy said hey...are you talking about those two Java Guys and told me the full names..i was shocked..I asked him as to how did they get in touch with him..he said they called us and told that they have H-1B visa and has the offer of $60K and if they can get more than that they will join us..obviously this guy gave an offer of 65K since he dont have to go throught the whole process of getting visa stamped from india ,and they transferred their H-1 to the other company.why not..getting a visa is very difficult in India and one will want to do anything before getting it but after that they get wings and get into terms of negotiating.If they would have told me that they want more than i would have paid them..but No...their intention was clear with few bucks you betray anyone.if they get 100 bucks more than they will leave that guy too..thats how it works for them.

You should be aware that these consultants dont look for stability.Its not necessary to work for the same company when u land in US..you can change your employer(H-1 Transfer).

Vick,

If you are looking for canadian citizens, why not employ them on a TN Visa?

Easier, much less expensive, and with no strings attached on either sides.

Once they are there, you find projects for them. I assume thats what you would do once an H1 guy enters US as no company is going to wait 3- 4 months for H1.

TN is a visa that has to be renewed every year and is entirely dependant on the whims of the immigration official at the border. A refusal to grant that visa cannot be challenged either. Imagine a situation where you are in the middle of a project and your anniversary for renewal comes up. You go to the border and the immigration official has had a tiff with his wife at home. He is in a bad mood and turns down your visa request. Reason - you have already been working in the US for 2 years and it seems that you are attempting to do that regularly.
Boom!!

H1 is safer. You are in for at least three years and quite certainly for another three if nothing goes terribly wrong.
