I got this in an email.

Quote:

Section 49-O of the Constitution

Did you know that there is a system in our constitution, as per the 1969 act, in section "49-O" that a person can go to the polling booth, confirm his
identity, get his finger marked and convey the presiding election officer that he doesn't want to vote anyone!

Yes such a feature is available, but obviously these seemingly notorious, leaders have never disclosed it. This is called "49-O".

Why should you go and say "I VOTE NOBODY"... because, in a ward, if a candidate wins, say by 123 votes, and that particular ward has received "49-O" votes more than 123, then that polling will be cancelled and will
have to be re-polled. Not only that, but the candidature of the contestants will be removed and they cannot contest the re-polling, since people had
already expressed their decision on them. This would bring fear into parties and hence look for genuine candidates for their parties for election. This would
change the way, of our whole political system... it is seemingly surprising why the election commission has not revealed such a feature to the public....

Please spread this news to as many as you know...Seems to be a wonderful weapon against corrupt parties in India... show your power, expressing your desire not to vote for anybody, is even more powerful than voting... so don't miss your chance. So either vote, or vote not to vote (vote 49-O) and pass this info on...

I checked the validity and found following:

http://www.liberalsindia.com/localchapter/net-02-02.htm

Quote:

2. Giving wide publicity to Rule 49O of Conduct of Election Rules 1961

In our Campaign we propose to ask the voters to vote without fail and also to vote for the best candidates among those standing in their constituency taking in to account the information furnished by the candidates in the Affidavit. In case they find no candidate to be good enough to merit their vote, we are requesting them still to go to the polling station and register their presence and then decide not to vote as per rule 49 O of the Conduct of Electoral Rules 1961. The existence of this rule 49 O is not at all known to voters. We request the Election Commission to give wide publicity to this rule so that those who do not like any candidate do not remain in their home but express their strong feelings in this regard by utilising this rule. We further request that all the presiding officers of the polling stations may be appraised of Rule 49 O so that they may not raise any objection or cause any difficulty to a voter deciding note to vote under Rule 49O.

We grown up in Indian and never knew about this.

It looks like there. There is one problem with this. We have secrete ballot system. By telling "I don't vote to anyone" the preson is rejecting all the candidates openly! In India such person may be screwed.

So the better option is to have a column "Nobody from the list" with all the laws of 49 O applicable.

It will never happen though :(

I too have recieved the e-mail regarding the same. Please read the reply from a lawyer.

Our constitution was drafted and adopted on 26-01-1950. It has only articles and no section. Election matters are dealt with from Article 324 to 329. I am sorry that the particular section has not been incorporated in the constitution.

Hi GG,

Though the clause 49-O does exists there is nothing of the sort above regarding the disqualification. In its current form it can only cause more confusion than the purpose we intend to use it for.

Just my 2 cents....
