Bounced Cheque

Hello Folks ,
Is anyone aware of the steps that can be taken when a fake cheque is issued
( Account was closed prior to issuing the cheque ) .
The amount is not big but I feel that I had been gouged and that too by our own desi fellow .
I had tried contacting the person but to no avail .
I am willing to spend reasonable amount if I need to take a legal action .
Any ideas wil be appreciated .

Small Claims would be best. If you have proof that the account was closed prior to the check being issued, it'll be a slam dunk. However, collection is another matter. Once you have recieved a judgement in your favour, you can apply for enforecement of the judgement if the same is not paid within 10-15 days. The court will then either help you sieze the defendant's personal property to pay for the debt or garnish the defendant's wages.

Prior to doing the above, send a strongly worded letter to this clown to let him know that you will be filing a case against him in this court on that date so he knows you are serious. The letter will be additional proof of good faith on your part.

If you win, you also get to collect the $100-$200 you will spend on this process :D

I agree with AswaniG. My suggestion; there is some fees and time consuming process involve in court procedure. You can spent $20-50 lawyer/paralegal fee and send notice by lawyer that you are taking this matter to court and he will be responsible for outstanding amount, all legal fees and expenses. Your problem will be resolved in a week of receiving lawyer's notice.
