Hello

I was in Canada for many years and am a Canadian citizen but due to reasons beyond control i was forced to come back to India for treatment.

The employer kicked me out behind my back and now i am kind of stranded in India. I had a sham arbitration by the employer where i lost my job and disability benefits.

I know the employer is in wrong and if i take them to court the arbitration will be over turned and i will get my job back. the employer is a Govt company.

I think only the media or the legal system can help me. I contacted one media house but they said i would have to go on record. What is the meaning of going on record ?

If there is anyone who can offer assistance regarding what recourse i have please IM me.

Any questions please IM me and i will clarify.

Were you represented by any lawyer there at the ARBITRATION Hearing. Most of these oil companies and off shore employers want to maintain a clean record and so they have high powered lawyers in their employ. They will not only cut you off, they will not retain you in their employment after any hearing as they are scared that you might sabotage their operations.

So, don't be a dreamer. Once you are out, YOU ARE OUTT.

Now for the suing them,
Do you have an employment agreement?
Do you have Health insurance? Do you have copies of the plan and the benefits that they provide.
Do you have the copy of the proceedings that was held at the hearing.
Do you have all of the addresses of all of the people at work at the previous place.
Have you documented the case with pictures, drawings, and witnesses withg their names.
Will they stand behind you or against you, They might be scared that they might lose their jobs.
Do you have all of the Hospital records and all of the records of MRIs, X-rays and the names of all of the Doctors that handled your case.

I DO NOT NEED ANY OF THESE DOCUMENTS OR PAPERS. But prepare yourself with all of these items that you will need to talk with a Lawyer there. That will be the very first item, which is be thorogh preparing a case against the employer.

All of these are valid for a place where you signed a contract, not where you reside. It looks like an international matter.

There are Supreme court Lawyers there ON RECORD, where you live. Find one and Pay him his fees and remember you will be without a job for a very long time. Look for a settlement and stop working after that. So, make sure you are well settled and dig in and fight.

Do not write here or into any public forum and seek help. Talk with a Lawyer first and keep all of the cards close to your chest. Then play it carefully.

REMEMBER, YOU WILL NEVER GET THE SATISFACTION THAT YOU ARE SEEKING, BUT MIGHT GET A COMPENSATION, and under the table. Also, most of the lawyers work on a contingency basis. You agree to pay them a percentage of the settlement. Some play both the sides.

Good Luck.

RECORD. : preservation in writing or other permanent form currently and for the future.
GO ON RECORD. : Very strongly hold and maintain a certain position publicly and seek redress in an open forum, by publishing.
