Family class Sponsorship refusal

I'm in distress. My wife and son is in India. I'm faced with some legal issues bringing them here. When I became a permanent resident, I didn't declare my son out of some reasons. Now it looks like the immigration officer is refusing to sponsor my son. I'm so worried. They let sponsorship for my wife but not for my son. My friend help get connect with with a lawyer,x xxxxx. The lawyer expressed confidence. But, I'm so tensed. It's time we finally set to start a good life, and again some more hurdles.

This is a legal matter. You have a good lawyer there who says that he will take care of it. So, entrust this matter with him and let it take its own sweet time and get resolved.

It has happened in a few cases. They have resolved them. The process is a long one and ask him to show the old results of such cases to you and you can read them and get to know the results also.

You are not opening up yourself to us here and I don't want you to also. So, leave the matters with the lawyers and find out more about Section 117(9)(d) from him. It is about NON Examination of a Foreign National. He will explain the complete details to you, because he is your lawyer.

Mr. X XXXX might be a good lawyer but a poor fiction writer.. he needs to improve his writing skills and invent better scenarios. I am still trying to figure a dad who forgot he is a child....

Hiren.. in a few cases, some due to stigma and in a few cases, intentionally (Filipinos) and in one case not being able to detect the conceivement, it did happen and there are cases that I know which I do not want to bring in here. But the OP is not opening upto us here and hence I said to Drop that idea. I do not want to pry it out of him while he is being represented by his own lawyer. I feel it is not fair to him. So, I will give him the break.

Well, a month ago, at an airport in Tennessee from where I was traveling on business, an announcement was made that said - "if any of you has forgotten your child by the baggage claim, please return to the area."

Then came the second announcement....perhaps to add clarity...."it is a 13 year old child." Hopefully, some one realized 13 years later that they had a child :)

Yes ... more creative work involved here.
These cases can be fought only under H&C where immigration minister can make a decision. Usually when some one is landing, the immigration officer at the port of entry will ask ... if any other dependent family member is there for the record ( no matter if he or she was included in the PR application or not for whatever the reason) ... if the deponent failed to declare there about the dependent ..... then the case becomes very difficult to win. Hence if some one is landing here and has a child who was born after the PR file process was over .... they have to be careful.
