My birth certificate in India is incorrect and I need to name my father as POA in order to have it changed to the proper name. My father put my nickname on my birth certificate instead of my proper name. How do I get POA in order to give rights to my father to do procedure to change my name in birth certificate as I am in Lindsay, Ontario. Thank you

There are TWO PARTS to this question. One such is there in INDIA. The the other half is here in CANADA.

The procedure to change name differs from state to state. The general procedure is that you have to make a name change. For this you will have to make a DECLARATION. This declaration is called an affidavit stating the reasons for name change and then you have to advertise in two leading news papers and give gazette notification, if required. Court order may also be necessary in certain cases. Then you have to submit an application in the prescribed format along with the affidavit and newspaper clippings and gazette notification to the respective authority who issued the birth certificate. Once you get your name changed on the birth certificate then you can apply for a name change in the passport.

Initially, For all of this to take place, you should get your name corrected in your birth certificate.

In order to do it in a proper way, approach the service center in your Municipality in your area where you were born and get an Application form. And also ask for the form for the name change application form, if they have one. Tell them that you want to Change your name to what Exactly you want it to be.

Fill the application and attach attested photo copies of your educational certificates, Aadhar Card, Driver's License and other identity proofs.

Your parents should submit an affidavit swearing that at the time of the registration of your birth they had got your nick name entered as you were not properly named then and that thereafter you were named as WHAT YOU WANT IT TO BE ………. which is mentioned in your documents and proofs.

You can also attach a certified photo copy of your ration card also where your correct name is there. (If it is there) This is to prove the names of the children in your family and that you are actually the one whose nick name has been mentioned in the birth certificate.

This may take a little extra time. It is for them to get the necessary verification done and your details corrected in the birth certificate will get issued to you on the scheduled date.

While you are there, apply for and obtain four to five copies of the said corrected birth certificate as the difference in cost is negligible, time taken is the same but extra copies turn out to be great help in required fields of life when time is short.

There are two types of birth certificates:- the full certificate. This is a copy of the entry in the birth register, giving all the recorded details.
The Second one is.. : The short certificate. This only gives the child’s full name, sex, date and place of birth. It does not give the name and particulars of the mother or father. A short certificate is issued free of charge when a birth is first registered. It will fit your wallet also.

NOW FOR THE POWER OF ATTORNEY..: Please find out if they need a Notarized Copy or one on the stamp paper. Currently they want it on the stamp paper and being an NRI, also might want it registered there in India. ( Now they also want a health certificate from a Doctor here in Canada stating that you are in good health.)

Do you Need a GPA or Specific Power of Attorney? If you want to make a Power of Attorney, you need to first understand whether the power to be given to the Attorney is for general purpose or for any one particular of specific purpose. If you wish to give all the rights you possess, then, for all your properties or all the rights for one property or all rights of banking etc. you should create general power of attorney or commonly termed as GPA. (Considering what you want to do in the future.)

But if you want to give the power to the Attorney to do any specific act (or a purpose, such as only the name change.. ) and after the act is done the power comes to an end. This type of power of Attorneys are termed as special power of Attorney, or a SPECIFIC POWER OF ATTORNEY. Special Power of Attorney is made only for a single task or act. You can hire a stamp paper vendor there in India to do that and create a Special Power Of Attorney quickly and in a cost effective manner. Then send the stamp paper to you here in Canada and get it notarized here by any lawyer or a notary public. It will cost you about $25.00 Canadian here. Cost in India will be a very small amount and the stamp paper vendor will provide you with all of the details.

Please make sure that you give them your CORRECT name and your CURRENT ADDRESS also. If you have any rental receipts or utility bills with your name, it will provide them with the proof too.
