In my case, I have clearly disclosed that I had not completed 1095 days in Canada on the day of the application - but my family had. Do you think they will still ask for my passport when I have already claimed that I am short on required stay?!

there is a very slim possibility, but i doubt it... usual standard practice is, anyone who does not completely meet the requirement in black and white, such as in your case, and the case is referred to a judge, and if required the judge will decide if s/he needs additional proof... but in your case, since your family meets residence requirement, and you dont (im guessing by few weeks or so) then judge has descretion in the matter... im pretty positive the judge will be convinced that you have completed deemed residency as your roots are well established... its considered an "allowed exception" and what will happen is, you be considered to have met residency requirement as a "deemed resident"

citizenship judges have wide descretion when it comes to this...

if you would like to read up more on the matter, then please refer to the operations manual for determining residence... read section 5.9

I do not recall the web site, but recently Ihad read on one site that there are 6 exceptions to the rule of 1095 days - and though they were almost same, it basically meant that if your connection with Canada is clearly established, (like family in Canada, house, car, income tax pmt, salary drawn), it will be deemed residence (like in my case where my job was to travel very frequently, but for periods ranging from 2 days to a month or so).

i know some one with the same problem now there is a problem they will delay your family case along with you as you have sent a joint application which obviously would effect their file as well i would have recommended you to apply separate but you apply together lets hope for the best if you are shorty of couple of weeks like 2,3 or maximum 1 month i think they would let you pass bybut if you are short of more than one month then they may be ask you to go in fron t of the citizenship judge

Applied in June 2010 -----wrote the test in the month of May 2011 and was called to see the judge on July 26 2011 as we do lots of traveling (shopping)-I called the call centre after 2 days seeing the judge and adv for oath on Aug 8th. Wish all of u good luck for a sooner result

No questions was asked about Canada, only why i travel a lot, and she said if we get good deal in the US and says our verbal English is fluent. Good comment. Got approved same day.
