Dear Sir,

I was illegal in US. I left voluntarily, went to canada and married my girlfriend. Came to India when visa expired. (2yrs ago)

Had interview yesterday in Delhi. Submitted a ton of letters, phone bills emails, cards and photos. The interviewer was clearly in a very bad mood, finding faults and being very unreasonable. I answered all the questions (hard and tricky qns) truthfully and accurately.

She said she was not convinced the marriage was real as i was illegal in US before and that quote "the letters, phone bills and photos have no impact". She told me she will look over the case again and reply in mail. Took my mails and Phone bills.

So its most probably rejected. She will take decision this week.
What are my options?
Can i ask to be re-interviewed with different person and have my wife present?

You will not be re-interviewed. Your spouse in Canada will have 30 days to file an appeal from the day she receives the refusal letter. Get her to get an immigration lawyer experienced in handling appeals. Don't get a consultant.

If you are actually and legally married and your spouse acknowledges this...no one can deny you an Immigrant's visa...it might take some time. I am ssuming that your wife is a Canadian Resident or a citizen....no need to go and waste money with a lawer or a consultant....however if your wife refuses, then buddy you better find another wife in India and stay back..

no she is also under consideration for PR under caregiver programme.
she has finished her formalities---everything.
i have contacted vegasman..
the case is very clear.
visa officer has reasons to doubt but they are legally married and are ACTUALLY IN LOVE AND THEY R HAVING REALLY TOUGH TIME.

But tell me really can she refuse the case?
because this person has 400+ e-mails.
daily one sms
married in Canada and got the proof(Canadian)
her family was present,his wasn't.
Her landlady given letter of good relationship and they talking daily.
rthis person given all this to the case manager(lady viisa officer)

cant she see that case will get approval in appeal?
does it mtter to visa officer that the case gets oked in appeal, which she had rejected?

one more important point she said
SHE IS NOT REJECTING THE CASE BUT WILL THINK IT OVER AND KEPY SOME PHOTOGRAPHS AND HIS PP PHOTOS AND ENVELOPES IN WHICH HIS WIFE HAD SENT HIM GREETINGS CARDS.

ONE MORE POINT SHI IS FROM PHILLIPINES AND HE IS FROM PUNJAB.
I KNOW PRIMA FACIE CASE IS NOT WITHOUT DOUBTS BUT THEY ARE MARRIED LEGALLY AND IN CANADA AND HAVE PROOFAND OTHER SOLID PRROFS.

TWO YEARS VISA OFFICER HAS BEEN SIITING ON A SPOUSE CASE.HOW CAN YOU JUSTIFY THAT?

They do refuge such cases. I know few from my close circle. You have to fight and have an immigration lawyer to get justice.

Though we belive that the marriage did took place, how to prove to the officer is a big question. If he/she does not belive it, you do not have any other option but to appeal. I think you can do it on you own, but it would be very difficult. I would suggest to have an lawyer (not a consultant). Massood should be your best option.
