since you asked a general question
Here is a typical scenario;
If you are involved in an accident ;
- You first have to report the claim with the Insurance co within 24
48 hours of the incidnet.
- Then Insurance company may go for an inspection to estimate the
damages etc.
- If it is "your fault" then your insurance company will be paying even
the claims by the other party.
- If not they will claim your damages from the Other party's Insurance
- Meanwhile if you vehicle is " totalled " or declared " beyond
repairable " then at lest within 30 days you should get the check for
the amount. That amount would be-
(Current Market value of your vehicle -(minus) your deductible)
Also if you have a "lien "( loan on the vehicle) then that amount will
not be paid to you but will go to the Bank which financed your vehicle.
- If the vehicle is "NOT totalled" , your insurance Co will arrrange
for a repair at one of their approved repair centers and get it fixed.
during the time of repair you might get a rental vehicle until your
vehicle gets fixed ( this is only if your Insurance coverage provides)
But you will have to pay your deductible upfront to the repair facility.
Plus if you or some one travelling is injured you can claim medical expenses based on your coverage.
All in all the entire claim process takes about 60-90 days to close.
But your vechicle if repaired will be fixed ASAP ( ususally 30 days max)but rest of the claim process takes time.

Here is my situation- I was driving when due to mechanical failure vehicle was involved in accident. No other vehicle involved. So this was a no fault accident and the police report was done at the spot. In these situations, a lawyer can get me how much, in what time and anything related to this, please share.

Ok things look a bit clear now;
With this situation as well the comments made earlier by me regading the "repair" or "totalling" of vehicle and the "claim" amounts and "time frame " for the process hold good.
When there is no other party involved why would you go to a lawyer at all ? even if you go there is nothing a lawyer can do I guess.

Depending on the policy coverages and limits your Insurance company will be covering it , here also you have to bear your deductible towards medical expenses.
normally when you file a claim, the Insurance Co asks if you are also claiming any medical expenses and IF "Yes", they give a separate claim # for medicals and this number you will be using against all treatments / tests and the bills will be submitted to the ins co by the Medical Institutes /hospital /clinics etc , while settling their claims Insurance co. will ask you to pay the deductible first. and that's all .
There are some Insurance companies in US where they pay money instead of treament expenses.
My freind and 3 of his colleagues also were involved in an accident ( vehicle got skid on ice/snow near Boston MA). they suffrered minor injuries as well. their insurance company paid $7500 each of them.
as per the coverage. within 7 days of the claim, but nothing else on mediacal goruunds, car was repaired and that's all. ofcourse he had to pay the required deductibles.
So lot depends on the kind of coverage (in terms of limits etc) you have.
