Hi
Here is my situation. I landed in Windsor Dec 1999 from Michigan (I was working there). And then move to Toronto still kept my US job (working online).
Paid my taxes too. Lost my job in January 2003 in US. Applied for citizenship in November of 2003, went for test in March of 2004 but the leady in the testing center had an objection that why I was working in US because I had H1 (working visa) stamp till end of 2004 (and according to her that means that I did not live in Canada). I told her I was working online and I lost my job in January 2003. She took all the info about my employer and told me that case will go in front of the judge and I can either go in front of judge or withdraw my application.
After a week or two I withdrew my application so I can spend more time in Canada and gather more proofs, lived in Toronto till June 2004.
Moved to US to help my parents but made sure to go back to Canada after every 5 months.
Now my question is since my parents are ok and I am planning to go back to Toronto and wants to apply for citizenship. What are my chances of becoming a Canadian citizen should I hire a lawyer? I have the following proofs:
1) Letters from the employers whom I worked for in Canada (but they paid me cash)
2) My apartment lease
3) Some bank statements from early years.

Some people told me that since I don’t have enough proof I can get arrested, is that true. If it is true then I am happy with my PR card.

Any feedback is appreciated.

You should not have withdrawn the application. You should have approached the judge (assuming you actually fulfilled the residency requirements) with proof of residency. But that's history.

If you have fulfilled the residency requirements, you should be able to prove it. Proof includes everything you can think of....

Import documents for your vehicle
Mover's receipt showing you moved from DTW to Windsor or wherever
Vehicle registration
Letter from your car insurance showing you have been insured since 1999 (or whenever)
Lease or mortgage history
Tax filings

etc, etc, etc

No, you won't get arrested just because you don't have enough proof.

Why would the lady in the citizenship test center looked at your passport? why did you take the passport with you to write the test?

Looks like there are other reasons for your issue. Please write it exactly here and then I try to help you.

This is Nov 06 already.. you are talking abt 04 application.. since then you lived in Canada? if so.. you should be more than okay..

Test centers do look at your passport (or at least require you to bring it with you to the test). At Windsor, they seem to look through the pages and question the stamps and/or visas if they seem inconsistent with the absences (or presence) that you have reported in your citizenship application.

Having said that, holding a valid/expired H1 notation in the passport is not evidence of one not living in Canada. H1 only indicates that one could legally live in US and the officer could interpret (wrongly) as one not living in Canada.

I took my passport because they ask me to bring it, in the letter I received for the test.
Do you guys think I should hire a lawyer for this or not?????

If that's the case.. does one have option of taking citizenship test somewhere inland.. like in London or somewhere?
