Cd's
I am a Canadian citizen. My brother recenly became a US citizen . He has made me an offer.
His letter is as follows (Names censored)

TK,

If you are interested, I can apply for a US green card for you here. However, I don't how that will affect R***a and S***a. I've heard that it can take upto 10 years for an Indian sibling (but we were told at the oath ceremony that it also depends on the nationality of the person for whom green card is applied for). You can do a search on I-130 to get more information before you decide.

Later,

}

Now someone told me that in USA if you pay taxes for 4 years or so , then you will be eligible for social security of USA in your retired life.
Does it make sense for me to :
1. Apply for Green card (if possible for a Cdn. citizen to do so or am willing to renounce my Cdn. Citizenship if that is the only barrier to apply for GC)
2. Get it around 2018
3. Work in USA from 2018-2022/23
4. Claim Social secuirty during retired life. (I have also heard that SS of USA if far far better than the CPP and OAS of Canada.

CD's, Your opinion please. I am sure that it may help other CD's in Canada who have their siblings in the USA.

First of all, please verify through reliable sources if a US citizen can sponsor his brother who is not a minor/dependent, etc.

Next, no one has to renounce any citizenship to get GC. GC applications as far as I know are based on country of birth and not on citizenship. Therefore, you may be subject to your country of birth's quota's/priority dates and the endless nonsense of US immigration.

Social Security in US is in dire dumps. It is predicted to go bankrupt. But, who knows what happens 30 years from now....

In order to be eligible for Social Security benefits, non-US citizens have to be employed and have been paying Social Security taxes for at least 10 years (does not have to consecutive 10 yrs). That means, if you are a student in a Univ and getting paid assistantship, this income does not qualify towards eligible employment since students don't pay SS taxes. (Now, please verify all my above statements through reliable sources).

Even if SS can be claimed after 4 yrs of employment, I don't believe you can afford any form of lifestyle with the benefits that have accrued due to only 4 yrs of paying into the system.

Hope this helps.

Thanks Dimple,
You post makes a lot of sense.
I guess 10 years of paying taxes would be the right time. Makes sense b'cos i know many software engr's who worked on H-1B in USA for 6-7 years and who are now in Canada are awaiting their citizenship so that they can work in the USA(Under TN Visa) for 3 or 4 more years to claim SS. And also as you said, No one knows the fate of SS in 30 years and the USA is expected to be no more a economic power house in the years to come. If it is 10 years, then i would not be interested in becoming a GC holder and also b'cos of the massive uncertainity of the SS system of USA.
Thanks once again.

TK,
{

This is true. I do know people who sponsered their siblings (and it takes about 10 years for Indian citizens). For parents, I think it's about a 4-year wait.
{

Maybe true. I will have to check on that.

Regarding social security, I believe everyone here has to pay and therefore, we don't have to think about it.

The lady who was seated next to me was a Canadian Citizen. She had been living on her green card since 1988 and was only now taking her citizenship.

As I heard, by end of this year they are terminating sibling sponsorship. You guys will have a last chance if this is true.

Somebody can Google it and find the authenticity.

TK Sahib,
Some facts

1) It takes about 15 yrs for ppl born in India to get GC using F4 or brother/sister route.

2) Dimple 2001 is correct. You need to work in US for at least 40 quarters (10 yrs) and pay SS taxes to be eligible for SS. However to meet elig you can work as little as 40 hrs in a month.

3) I would say go ahead and apply and then go to sleep. To apply is not that difficult process and only costs US $ 190 so whats the harm. You will need some documents like birth certificates etc. Here is a link to the form

http://www.uscis.gov/graphics/formsfee/forms/i-130.htm

4) Whats the harm in applying. Always good to have options.

Thanks Texas Cdn. and GG for the inputs.
My brother has repied as below to all your comments. One comment which i find disturbing is if i could be refused a TN Visa if i have filed for GC through the sibling route. If it will not, then i am going to apply for GC. Who know, It can be helpful to me.
Answers appriciated.

TK,

I think the statement about the waiting period being determined by the place of birth may be true as an indian citizen born in Saudi was able to get their greencard quicker. If that is true, it can take 10 years. While we could apply and let it take it's time, it could pose other problems in the interim. For example, if you have applied for for a greencard and thereby indicated an interest in immigrating, they will reject other requests you make such as student visas and so forth.
