I seek your help in understanding a few things about the Immigration forms. My cousin , currently in the US, had applied for the Canadian PR, through the Buffalo office . He despatched the forms in Nov 2003 and has got a response from the Consulate with all forms returned back ; the reason:
-No personal cheques would be accepted,unless certified by the bank
-Blank sections to be marked "N/A"
-IELTS required in place of written evidence of Language Proficiency
He visited India in Aug 03, though he has been residing in the United States for +3 years now. The Consulate has sent a form that reads " You must provide evidence that you have been lawfully admitted to the USA for a period of atleast one year" .
Pls guide if he needs to submit the I-797 for this purpose
And the entire set of forms could be re-submitted.
Appreciate your guidance in this regard

Dear Masood, I am sorry; I missed out this detail that the application was under the Skilled worker category.
resubmit entire application and respond to their concerns. I don't know what I-797 is.

Dear Masood, Thank you very much for the guidance. I-797 is the form obtained during the H1B visa status.
Pls guide how soon the forms could be re-submitted. and if a fresh set of forms need to be sent.Is it advisable to also show proof of relative in Canada, would that help.
I am also given to understand from my cousin ( principal applicant) that however, the dependent applicant is yet to complete 1yr of stay in the US; do u think this would be the reason for the Consulate to send the forms back.Pls guide if my cousin could re-apply immediately or does he need to wait till the dependant applicant completes one year of stay in the US, to process forms through the Buffalooffice.
Since these questions came by after my first query, I am repeating the query with more details.Really sorry about it.

Masoodji I am replying for this, If I am wrong pls correct, if not I will be happy to have releived you of clearing petty doubts like this.
It should be submitted as early as u can, Burden is on u. Showing relatives will help only if they are in the first order of the applicants family.
This one year is so confusing for many (they have to be legally admitted in to USA for a year or more and not necessary that they should have lived before applying. So u dont have to wait till they complete one year.

After reading this post, I checked the photocopy of my own file. I have realised that under the heading of education, (Number of years successfully completed in Trade School or other post secondary school), I have left a blank. Actually the answer to this should have been zero or N/A. However, all other columns on education are complete with supporting documents.
I have submitted the application on November 13, 2003, and my fee draft has already been encashed by the bank on 22 November 2003. ( I have submitted IELTS results and Police clearances as well). I have filed my application at CHC Delhi.
Can a file be returned after encashment of the demand draft?
