IF WANT TO MOVE TO U.S.A AFTER APPLICATION OF SPONSORSHIP?

Hello sir,

i applied a sponsorship application for my parents P.R file in Oct 2006. i am P.R of canada since last 3 years and will be eligible to apply for citizenship in October 2007. I was planing to move to U.S.A on H1B as i have sponsorship from one of the company in January 2008.

i will apply for citizenship In oct 2007 but most probably i will not get my citizenship by Jan 2008. Will it affect to my parents P.R file if i continue filing my Incometax return and my family( wife- cosigner ) will be staying in canada only for atleast 1 more year.

pls advise me as i have to file my H1B on april 1st.

I was in same situation 2 years before. My lawyer have guided me, not to leave country as one of the sponsership requirement is 'you have to presently be in the country while your sponsership in process' Also, They consider the point once you bring your parent in canada where they will be? how is going to settle them? how is going to take care all this point if they find out you are not in the country, it can be problem. So my lawyer said.. this is the rule. now its up to you to go or not go. If they will check, lawyer will not able to help.
However, I was waiting for parent immigration for so much long..and it was important for my parent so my decision was to stay back in canada and wait and then help them in settle and then go.
But in canada job market is sucks.. so thts why most of the ppl want to go on H1b.
I was also in same. so what I have done, for security I have bought the house n i had company which is incorported so I was trying to get the contract on company base and go for canadian business, tht's the way I can show my tie ups in canada. even thought on H1 B I have to work somewhere as consultant, so why not for my company. you can also save so much in incorporation for taxes.. just need good CA who can help you to fill both US and canadian.
Also, I was in same loop .. i had applied for my citizeship..so I thought i have waited for 3 years here..not why not 1 more...and do everything correct with less risk and tension.
by paying both taxes here and in USA..you are not going to earn so much.. money over there. If your wife have sponsered them, yes ..if you just keep your wife here can solve.
I am not advising do..what I did. but just leting you know my exprience and what i learnt out.. clearly from canadian immigration site in document the rule is phsycially to be present in the country while you are sponsering. now I am not sure they do check all this or not. only my lawyer recommneded he cant gaurntee me..that immigration will not check this..and if they check this..lawer can't help me out..as its rule.so lawyer have told me to do it or not on your 'own' risk.
I would suggest you to check first is your all prority to bring your parent..or H1B..
see.. my point of view..you can get H1b later..but if you lose your file..must be hard to do everything again..also sometimes.. ppl bring their parent..just to see they like it or not..and most parent dont like here..so its really upto your priority.
I am happy today, my parent are here in this country. I am 8 month preganet..and everyone from family here to take care... i have heared from lots of ppl.. difficult to handle pregancy here for desi's being alone.. doing lots of work. also happy that my parent are here so anything happen to them.. we dont have rush to india..and we can take care here well. so that was priority for me..then anything else. like h1b ..money etc...

thanks a lot for the great reply u sent to me. Yes my priority is my parents too but to be honest after being in canada for about 3-4 years i am still looking where should my career be.....

i m just confuse as my parents forcing me to make my career first and i am the only son for them so i want them to be here asap too.

I really appricate that your parent is in your priority list, also its imp to being only son you bring them here; otherwise you will not able to take care of them. You can get doct/nurse in india when they get sick ..but wht about comfort, care? Now a days, very less ppl thinks about it. so its good that you re thinking of it.

Let me make another point. How old is your parent ? how's there health ? Canada immigration also go into detail for medical test, so I would make a point to bring them 1st while they are in good health. You can make your carrer any day any time ..any where.. making carrer shdn't depend on your location. If we have ability we can make it any where in the world. Opp. is everywhere.....

Infact, I was thinking same. But after my parent came, I was able to give more time.. in study, applying..and very relax.. that i hve someone here.. so after they came just in 3 month I got very high position job, that I have never thought of it.. Its my ultimate dream job. Its bit far away, but becoz now my mom is here, I dont need to cook that much..so I can effort to have 20 mint.. more in commute..and taken life time oppt..
My thinking is..you do good ..it always returns.. if I would have just thought of my carrer.. going to usa on H1b.. I would never had this kind of High position.. I had dream of this high position..after may be 3-4 years in future. But as surprise it got click ..may be i was able to more concentrate, study more..etc.
so about carrer.. I think you can make it here.. also. its bit hard, but once your parent will be here, they will help you in so many things.. and you will also able to take care of them.
why we earn money and make carrer.. my point of view is for family ..so without family what are you going to do with $$$ ...

Again, making point try to bring them here when they are in good health to pass medical exam.

choice is yours.. sometimes.. we cant get everything at once.. have to make choice.. may be your choice will bring bright carrer in canada itself..u never knows. we cant predict future. we can only work hard behind it.
I feel, if you can get H1b and get good job, you can do it here tooo.... canada is also great land of opp.....
