I dont think you need a Lawyer to point you out that 'you can't get out of contract' or 'you have to close the house'. Its very clearly written in agreement.

May be you can change/amend
- Closing Date
- Some other 'small' things - which does not really mater even if is not get changed.

My experience with Mattamy has been excellent. Can't complain. They have not left anything behind.

Always in the contract put along with you name “and or Assignee". This will allow to assign the contract to some one else. If you later change your mind and want to assign the contract to someone else. This is valid clause even for resale homes and even if you are buying through realtor.


If the builder does not allow the "assign" clause you can put “and or nominee". Nominees are normally related to you.

Nope ... ... most builders wouldn't allow this clause in the first place- second - if you have a stupid builder you still have to assign it to someone else - good luck !#$$# The builder probably has a clause saying you can't list it on mls while title is still in the builders name.

Regarding resale, You might get away with it when the Seller does not have proper knowledge about the pros and cons and or is unrepresentated by a good realtor - but a smart person would NEVER allow this clause to be inserted : )

Bottom Line, Lawyer or no Lawyer ... Buyer has to Close the House.
