CD's, I have been terminated of my job giving the reason of" departmental restructuring". I was there for 1.5 yrs. I have been given the termination release which I have not signed off. However 4 wks and all vacation pay is bieng offered.
1. Should I consider going through a legal way (lawyer)?
2. Though the offer is not bad, somebody told me if they hire somebody else to replace me then the injustice will be unheard if I just sign the release without giving legal consideration.
3. If so,can any body give any lead to good lawyer contacts.
Thanks.
sumu,
1) NO
2) If the offer is not bad, then you know what you have been provided as a settlement and what is owed to you. You can sit down with HR department or with the Accounting and ask them for the breakdown as to what it is that they paying you, to pack up and leave.
If it is stated in their letter of severance and the dollars offered are clearly to what you are entitled, then, their offer is EXACTLY to what you are entitled to. No more and no less.
You can also contact the Ministry of Labour and ask them, providing them with your rank and job description and the location where you are working and they will tell you if it is just or unjust dismissal.
3) Just to provide you with a peace of mind, they can hire another worker in your place by just changing the job description a little and hiring the next person under a different title. There is no way of knowing that unless you have people on the inside who will squeak on the employer and risk their current job.
I am afraid that I am in no position to tell you to 'See', 'Speak to' or 'Consult' a Labour Lawyer after noting the contents of your second paragraph.(2) But you will always get a twenty minutes of free consultation from a Labour Lawyer near by, by paying ten bucks to the legal referrals call line, who will provide you with links to TWO good Labour Lawyers at your location with a contact number. Currently the Lawyers do all of these over the phone for free, if you have affinity to a leagal service, either paid or through the unions, or with affinity to Professional bodies.
Sorry to see that you lost a good paying job. Now be fast and do not tarry. Look for another one right away. You will get it too.
Good luck and great hunting.
Freddie.
Hi,
Sorry to hear the termination news.
Do you have enough time to think and accept/decline the termination offer ?
If so do the following;
1. Compare/check the terms of this termination offer with your original employment offer's terms and conditions. if they do not match you can ask your HR for clarification on those concerns.
2. Consult a good laywer before taking decision on the offer.
3. Most importantly start looking for a job, and if you get it before making a decision on this termination offer - then probably you will be better off.
Good luck.. and please do post further developments.
