Parents Sponsorship (important question)

Hello CD's

I would like to get your advice regarding the issue of sponsoring my parents to Canada.

Both my wife and I landed as PRs in April 2007. We left Canada in a couple of days to wind up stuff in USA and returned in July to settle permanently. Now, I want to apply for my parents’ sponsorship. Here is my question:

We complete 12 months from the date of landing in April 2008. However, we have been out of Canada for 3 months. Will this affect our sponsorship? Is this the right time to apply for sponsorship or should we apply 12 months from July 2007 when we moved permanently?

I called up the CIC call center and the lady said that I can put the details of my US employer in the form for the first 3 months.

Just wanted the advice of fellow desis as to whether it will affect the sponsorship approvals. With both me and my wife as co-signers, we easily surpass the LICO.

Hi vijulibra,

I had similar question when I initiated the process to sponsor my parents 2 years ago. After some investigations, I found that it's better to sponsor parents after completion of at least 1 cycle of filing income tax returns in Canada. This makes it easier for Citizenship and Immigration Canada to decide whether one meets minimum income criteria required to sponsor parents.

But since I have already paid taxes for this year, and the amount does not go above LICO, I thought of doing it through the 12 month income method. That way, I will not have to wait till April 2009 to file the taxes for 2008 and get an option C printout.

Anyways, thanks for the tip.

Hi vijulibra,

I don't know your specifics, however, you could have shown three months income from U.S. and remaining 9 months income from Canada while filing income tax returns in Canada. If total income for both of you, meet minimum income criteria, for last 12 months, than I guess it would have been good to go.

I am not sure of time line for revised submission of income tax returns with Canada Revenue Agency. You may try this option as well, if you are sure that both of you meet minimum income criteria for sponsorship of your parents.

Your point of not waiting for 2009 is absolutely valid.

Thank you for the update. I cannot file an updated return in Canada since they have already assessed it.

Considering the fact that I have already filed the US and Canadian tax returns, is it ok if I mention the US salary on the Canadian Sponsorship form? If the immigration department shares the data with Revenue Canada, will the Revenue Canada create problems for me?

I have paid taxes in both countries, but I have not mentioned my US earnings in Canadian tax forms.

Please guide me as to how the data sharing between Immigration and Revenue Canada can affect me or my sponsorship applications.

I assume it should be income earned in Canada (not abroad and hence US income may not qualify unless as specified below). 2. You must meet (and prove it) that you have earned required minimum income in Canada (after becoming a PR) within 12 months prior to filing sponsorship application. US earned income may be counted only if you reside in Canada, commute to work to US and return back home to Canada after work and that such income has been included in your Canadian tax return. So, if you don't have income from Canadian source but declared income from US source in your Canadian tax return then your claim of residing in Canada may be subject to stricter verification.

If after filing the sponsorship application and upon its approval does leaving Canada affect the processing time ??
