The rule....if you look in the actual rule(IRPA) documents is that you need to fill the residency obligation in every 5 year period, not just the last 5 year period from when you apply.
The application form makes you think it is only 5 years from the time you apply, but that's nor correct.

Most or all of us came from the same neck of the woods. We studied and moved into this country to make a good life for ourselves and also to the family and the next generation. We have gone through a lot of difficult times. Some we encountered and some we created ourselves, with none to blame. We try to find a few simple solutions and we come to this board seeking some help. We try and over come them some how. If we cannot then.....
All of a sudden we find that little something starts to bother us a lot. The problem becomes insurmountable. It knocks the daylight out of us. We get into this website and write to each other in an anonymous fashion, quoting everything that makes sense, but forgetting how the problem got started and what it might cost us, to rectify the same.
People come to this CD website, some seeking help and some providing a little solace and some with tangible solutions and some Camaraderie, we created a clearing house of sorts for everyone. When you wake up the next morning and see your problem or your troubles evaporate, you feel that the whole world is your friend. When it is one such instance which no one has come across and has neither encountered or seen it resolved, it becomes an enigma to everyone. Though we read and understand all of the points that you put out in your vehement statements, we find that the resolution that you are seeking is at a location, which is strictly regulated and is Legal in nature. Hence we steer you to the right location where you will find the appropriate person and the correct solution to it. You do merit a solution for it. Some times there is a price you pay and I hope it is a very small one and it does not hurt you too much.
If perchance, I suggested to you an alternate solution, which came out my hat and it is not the best for your needs, I would suggest that you please put that aside, knowing that it is not suitable to your current needs.
Though I empathize with you in your situation that you are in, at your times of trials and tribulations, I find that the place where you should seek a resolution is elsewhere. I want to see the problem resolved for you. I also want to see you stay here and settle down in life. Some time the number of days that you spend either waiting (to get immigration into Canada) or working towards your citizenship does not add up to your expectation, I want to tell you that there are hundreds more like you, who are in the same boat as you, living here for a long long time, never ever thinking about getting their Canadian Citizenship or wanting to obtain one. They are happy with themselves. It is a state of mind.
But you have to learn to count your days all over again, because you did forget to count them some where in the past, and bring yourself in line with others who are doing the counting the right way, and go on from here with a fresh start. I don't know what brought about this situation in you life. And I would like to leave the subject untouched and in due course of time, hope you put the same behind you and heave a sigh of relief.
I put myself in your shoes, before I started to write this. You are the only one who knows that any closer than this is like...... and I want to make a statement here : and I don't know you at all and we have not seen, talked or met any time.
What I wrote here is from the bottom of my heart. I sincerely wish you all the best and hope you resolve this in your favor in due course. Let patience be a virtue and your guide.
Freddie.
One of the options is dont apply for renewal.. just stay on..
PR is permanent residency.. U dont lose ur PR until a removal proceeding is started against u.
Ofcourse u will have trouble sponsoring anyone else..
If u entered after a 3 year absence u are in automatic failure of meeting the residency obligations.. So u have already become illegal in true sense unless u lie..
I was out of the country for 2 yrs 11 months 13 days and then returned.. I was honest when i flew in, they had me go through a immigration interview and then let me go..
I was warned if i go out of country for more than the remaining days i would be deported..
Lawyer will not be able to help u unless ur spouse is a citizen..
