Taking this citizenship application situation further - Please help

Hi,

Many questions I have are common and hence I have taken care not to repeat them. My situation is as follows:

I complete the 1095 days criterion for citizenship application in December 2008.
I landed in Canada in August 2005 (as a Permanent Resident) and returned to India in early September 2005. The reason is that I had to make arrangements to relocate myself permanently to Canada since I landed myself a job in B.C during the one month visit in August 2005.
In Jan 2006, I returned to Canada and have stayed in B.C. since then. And I complete 1095 days of continuous stay in Canada in December 2008.
I intend to apply for Citizenship in December 2008 and leave in Jan 2009 to India due to a family concern.
I have the following questions:
1) Is it likely that my citizenship application will have an issue due to physical absence from Canada between September 2005 to Jan 2006? Please note that in December 2008, I complete 1095 days after factoring this absence.

2) Do I need to notify CIC since my absence is going to be more than 2 weeks?
Or would it be better to notify CIC since my absence is going to be more than 2 weeks?

3) I will have given my local guardian's address in the citizenship application and will expect my local guardian to follow up any mails/notifications from CIC and inform me so that I could travel to Canada when required. Could there be any issues here?

4) I would like to know how to follow up on tax returns filing in March -April 2009 when I am away in India?

5) Is there a form to fill out to sever financial ties with Canada? If yes, when is the best time to fill out this form. My concern is that filling out this form should not come in the way of the processing my citizenship application and increase chances of routing my case to the citizenship judge.

6) At the time of citizenship test or oath taking ceremony, will the CIC be aware of my physical absence from Canada after submission of my citizenship application? If yes, how?

I would really appreciate your advise/help with the above questions.

You would have completed your required three years by the end of December 2008. Soon after that you will be moving out of Canada. Hence, when you move please give them your new address that you will be staying at. If you provide a local address for the mailing they will think that you are still here in Canada.

If your intentions are to live here in Canada and be a Good Canadian Citizen, then they will provide you with the Citizenship. ( I will provide you with the reasons at the foot of this letter )

Since you are leaving Canada and will be made to account for your absence at a later date, with your passport entries, it will become very clear that you have left the country for what ever the reasons you might have, for your departure. You must answer and satisfy the Judge with suitable answers, IF asked.

You don't HAVE to write and tell them, but it will be good to keep track of the same with travel documents and expenses and other records for the number of days that you intend to go away. There are a lot of business people who live here in Canada for six months in total and go away for the rest of the year. All they do is keep track of the time and dates this way.

The short notice that you will be given to accomplish the 'writing of the test' and 'Oath taking Ceremony' etc., will put you in a bind and if you post pone the same might give you away, when you are made to account for your absence.

Any issues that might arise could be considered trivial by the judge and it is at his or her discretion. But do remember that you are the one that is made to account for and you have created this monster. Also, since this will take more than six months, which is done deliberately, you might be required to provide them with a POLICE Clearance from the country of your residence or the visit, since it exceeds that time span. You now know that you have been warned about it.

Your tax returns are a minor matter and there are others that will help you with this. Sine it is also "E-Filed", you have access to it on the net. You can print and mail it to your local guardian, and ask him to mail it locally with the 'T' slips.

For time immemorial Canada has been keeping track of the immigrant's movements with the arrivals and departures list of Passengers on Boats, Planes and Public Bus transportation. They know that you are coming or going "even before you board", because of the no fly list and safety checks at the Air Ports.All of these are compiled and they know a lot more than you and me. The big brother has been watching us all the time.

I will put the severance part with Canada out of this discussion altogether for now.

You have to get all of your ducks in a row and you came to the right forum for this. But you are 'jumping the gun' with each of your questions and you are not even at the starting gate.

You are a very ambitious person and I hate to see you trip and fall. Some of my answers may change the course of your plans and if it does, it is because I want you to err on the safer side and succeed with your plans, and may be with a slight delay. These are some of the things that you will have to learn to shake it off in life.

First Understand the system and then, learn to play with the system. And......

Thanks a lot for your detailed response.

I was wondering if cancelling provincial health coverage after I leave Canada will be an issue? I would not mind keeping my bank account/transactions alive but having to cotinue paying premium for the health coverage (in absentia) till the time citizenship is finally obtained, could be very expensive.

You pay for what ever that you want. What you don't pay for, you should think if it will come out in the wash, in front of the Citizenship Judge, IF they call you to answer.

I understand that you are living in a Province that charges you for your health Care.
In some they take a lump sum at the year end or at the source. Here in Ontario we can be away for a seven month period.

Hi Freddie,

Yes, I live in a province where premium for the Health Care Services are charged on a monthly basis.
So, to summarize, you are saying that it doesnt matter whether I continue to pay the premium after I leave Canada or whether I discontinue the payment. At the end of the day, my case can get routed to the citizenship judge in high probability. And there, it is all up to the citizenship judge to buy my reasons or to reject them.
If the reasons are not acceptable to the judge, does it imply that I do not get the citizenship or that my case will incur longer delays and heavier expenditure for me in terms of repeated travel etc.?

From your posting and statements made, yours is a clean application that merits the issue of Citizenship. Do not complicate the situation after filing. See if you can stay here and get your Canadian Citizenship and the Passport. Then Lv......
Keep on working till then.

They put you through the hoops and the hurdles. I am just pointing to them. Also play your cards close to your chest, no one need to know your hand.

Hi Freddie,
Many thanks for all your answers. I was getting my papers in place recently and I noticed the following.

1) I left Toronto on 27th August 2005. As proof that I left on that day I don't seem to have preserved the air ticket or any other proof of travel on that day except that on my passport there is a stamp indicating I arrived in India on 29th August.

2) I permanently moved to Canada on 12th Jan 2006 (Thrusday). Again here, I don't seem to have preserved the air ticket. A stamp on my passport indicates that I departed India on 11 January 2006 (Wednesday). However, I have

a) my Hydro Bill which indicates that my hydro services were activated on 13th Jan 2006 (Friday) .
b) lease agreement copy of my apartment which indicates date of occupancy as Jan 05 2006.
c) My Record of Employment letter with my Canadian employer stating my joining date as 16th of January (Monday).

In my citizenship calculator, I have counted period between
1) August 1 - August 27 (2005),
2)January 12 2006 - January 1 2009 (date of application) to confirm that I meet 1095 days of residency requirement.

Note: between August 27, 2005 to January 12 2006 I have stated absence due to family matters and to facilitate permanent relocation to Canada.

Will the issues in 1) and 2) -> not having more proof than stamps on my passport, cause a problem?
