Is it worth to fight for speeding ticket ( money & time ) ?

Here is situation for my friend & need advice -

- He was driving on Highway ( speed limit 110km) & got speeding ticket for 132km
- He was driving around 120km +- 2Km (as per him)
- No camera, temporory cop vehicle etc on road. Still found one cop in vehicle suddenly come from behind, stopped him & told him about high speed & caught in Radar
- He didn't argue, but simply took speeding ticket. Found $136 as fine

He has 3 options -
1. Pay fine & done
2. Go to court & agree
3. Go to court & deny

What are the chances of winning in case decide to fight speeding ticket?

He is not much conern about FINE amount but worried about demerit points which is 3 as driving above speed limit by 15Km but less than 30Km

How many days/year this demerit will show on record? Will it affect Car Insurance

What is the best way to fight such speeding ticket? Hire agent, do himself etc..

Also this incident happen almost 200-250 km from place of residence. So naturally all court cases etc will be at that place

Do anyone knows, what exactly happening in Court on given date?

Also for information - this is my friend's first incident related to speeding etc in Canada. Also no accidents.

It happen in Alberta

One can never really argue with a cop about a ticket.. it never plays well so glad that your friend didnt :)

Regarding the ticket, I don't know about Alberta but i can tell you of my experience in USA and hope it helps:
I got a speeding ticket and i didn't pay it for the reason mentioned below by you and i contested it. The rule in USA is that if the cop who gave you the ticket doesn't show up to court, the ticket is dismissed. In larger cities, it usually happens that the cop doesn't show up but in smaller cities, cops definitely show up and if the cop is there, it's usually his word against yours.

Since it happened so far from his home town, I'd recommend that he speak to some traffic violation officials and get an opinion and possibly look into getting some representation so that he doesn't have to do all the leg work him self. I'd also check if there are any courses (in USA they have defensivedricing courses, which if taken waive the ticket but i don't know of any in ONTARIO at least).

Can some one write more specific to Canada/Alberta

What can happen in Court?
On particular court date - time written is anytime between 9am to 3pm

That means he has to wait for Cop for that much time in court?

Is there anyway - my friend appear in Court & accept FAULT & agree to pay FINE amount but request to waive Demerit points?

I too have related question

When one hires RENT A CAR, after some aprticular speed say above 120KM
some typical sound comes frequently if Radio is ON

I heard Communication Tower changes RANGE, is it TRUE?

May be Rent A Car has some instrument which is catching RADAR of Cop

Just want to confirm?

We did it ourselves. Time is fixed on a day.... 9 to 5 is court time but your slot will be 2 hrs.

Outside court room is listing of cases to be dealt that time and police officers name in each case, if your police officer has many cases, chances r he will show up, if just 1 probability is less. If policeman does not show up, its over, no fine , no points, no explanantion. If he does come , u have option of accepting guilty, in which case judge can reduce fine but i am not sure of points, if u want to explain your side, then judge has to decide and cld be any outcome.

When we went, i was well prepared and am an orator but when i saw court envmt, judge, lawyer, all formal and disciplined, i must admit, i was nervous to speak and told my husband lets just plead guilty bcos then all you have to say is yes when judge asks plead gulity (though my husband was not nrvs n well prepared). but fortunately cop did not come and we were free but as soon as we were out of court, we saw cop coming in but we just ran as fast as we cld....kidding. oh sorry, actually we had an issue with ttc bus so bus driver did not ocme, and cop was really mad at driver coming 1 min late.

if u r not worried abt $ and really worried abt points, u can hire someone, which is no gtee....but at least wont be nervs ...on other hand we had a case, a v old man, his hired rep did not show up at all....and he kept waiting....

Can I request to change the court case date due to some emergencies or I have to appear in the court in any circumstances?
