My son got a notice from court of justice informing him that he did not obey stop sign on 29th Dec 08. Penalty is $115. Last day for payment is 14th March 09. The letter was received last week. My son was never given any ticket and the car is in my name.My son's name is there in the insurance as occasional driver.I want to know how the letter was issued in my son's name without issuing any ticket and when the car is in my name.How could they identify that my son was driving without issuing a ticket.
Both of us are not sure who drove the car that day as it is almost two months before.But both of us are sure no one stopped us to issue ticket. There is no mention of demerit points in the letter.Can some one guide me what should we do to avoid demerit points as my son is under 25 and I am already paying a high insurance premium.

i believe the car is registered on ur name....so the ticket shud have came on ur name not ur son...
i have heard of receiving tickets for breaking traffic lights..but not stop signs..
The car is registered under my name. What surprises me is that without stopping and issuing ticket on the spot, how can they send the notice of fine that too under my son's name.
That was a good one morning rain, but both of us are safe and careful drivers.

Are you sure it is a genuine letter to start with? There were scams in CRA's name... won't be surprised if this is a new schema. You may want to call and confirm...
For any moving infraction ticket issued, you are required to sign the ticket in front of the officer before he can tear it off his pad. If your/your's son's signature is not on the ticket, it is obviously a bogus ticket or illegal.
1. Call them on thier phone number and verify if they really issued this ticket.
2. If the ticket is genuine, file for appeal and request in writing 'proof of issue' and proof of ticket delivery confirmation.
Once you have the above 2 you can figure out the issue and decide what route you wish to take to resolve it.
