Dear Sir,
I am holding a permanent resident card valid till 06jun2010.
I am in India from June 2006,due to pending financial and property related matters.
I wish to return to Canada in April2009.I suppose I will not require a VISA when I travel to Toronto during this period.Please confirm and reply.


Next,I landed in Toronto on May18,05-worked and lived till June13,06.
My 5yr period for permanent residency status would start from the day of landing,i.e
May18,05-May18,2010.I stayed in Canada for 395 days.(more than1yr,but had to return to sort out property/personal/financial matters)

I stayed in India from June13,06-April09(will be leaving in April09).
I wish to spend 365 days from May09-May2010 in Canada for completing the residency requirements of min 2yrs stay in Canada out of 5yrs period.Please inform to me about this and whether I will need a travel document or not?

You can enter Canada as you have planned, in April 2009.

You Do not need a Travel Document.

You can stay for another year or slightly less and complete the required two full years and apply 30 days prior to the expiry of the PR Card, as marked on the card.
Then wait for their letter to pick the new card up at a location closest to where you will be living at that time. Then exchange the card for the new one.

You will have to fulfill three good years to qualify for the Citizenship. Keep all of the dates and locations marked and all of the required passport stampings etc., in a chronological order. (Even stubs from the air travel ticket will help if needed to authenticate.)

OR

You will have to have two full years of stay here in Canada to renew the card once again in your second stay of five years.

Hello Folks,

To complete two yrs. residency, I need to move to Canad by end of this March.
I plan to move end March but my family cannot move before the end of school year that ends on June 29th! They will be short by 3 months for the PR renewal later on in 2010.
Should I just ask/tell the Canadian Immigration authorities now in advance about the situation or should I worry about this closer to the end of March 2010 when we'll have to renew PR cards for next 5 yrs.
We have full intent to be a citizens.

Please advise

The Immigration and Refugee Protection Act gives Citizenship and Immigration Canada the authority to grant permanent resident status to individuals and families who would not otherwise qualify in any category, in cases where there are strong humanitarian and compassionate (H&C) considerations, or for public policy reasons. The purpose of these discretionary provisions is to provide flexibility to approve those deserving cases not anticipated in the legislation.

Here is another link. You will see in that report that they granted 6653 people under the H & C Grounds. The legal society has full breakdown of the cases and the reasons for admission. You can retain a Lawyer at that time if it becomes necessary and get the removal order squashed. But there could be one and I want you to anticipate the same for the family who will be traveling later and not able to fulfill the requirements. So, be guided. These are normal procedural things. No need to fear about it. You know NOW. You have been warned.

So, come on down and get the family later. But if it is not that crucial, then get the kid in here and let them get trained here with COACHING from qualified teachers and even skip one year and get into one grade above the level that you think that they have attained there in India. DO NOT COMPLICATE the issues with your own thinking. Bring them in with you and move on from there. We have excellent coaches here who will do wonders for you. Also, that depends upon where you migrate to. Toronto area is filled with such teaching schools and it will be well worth considering after you do your own due diligence. But you have a very short time period to do that, if you want them to travel with you.

Pull up your socks and go hammer and tongs with the issue.
