Guys,
I was rear ended in the 401 today morning. These are the details that happened.
I was in the right most lane and traffic was moving very slowly. The traffic comes to a complete halt and then moves and then again comes to a complete halt senario.
I was in the 401 EB and going to the ramp to the 400. There is entry into the highway from Weston road in that area and hence a lot of cars want to go to the 401 EB from Weston road as well as people from the 401 EB want to go to 400.
I was stopped and started to move slowly forward when I heard a loud sound. I looked in the mirror to see the woman in the car behind me move forward in her seat (she was just rear ended) and then when I looked on the road ahead, the car from the back hit me (a bit heavily) and I stopped.
When I got out, I saw that it was a 4 car accident with me as the first and 3 cars behind me. The car the most behind of me was the worst hot as well as the car before it. The car behind me was not that worse hit and my bumper had the number plate marks / dents of the car behind me and well as the bumper came down by 1/4th. of an inch.
The last 2 cars were junked totally (new cars).
Police came and took all of us to the police station parking grounds where we were told to write what happened. I wrote it down and the officer wrote a vehicle accident report and told me to contact my insurance. he also told me that since the report has space for only 2 vehicles , he could only fill up 2. The vehicle report contained only names, addresses and insurance info. and no write up of the accident. He also wrote a reference number on it which he told me to inform my insurance.
I have not gone through this process at all before. can any CD advise me of the next steps. Are there any tips that CD's can share with me so that I am not cheated by the Canadian system.
FYI, I have only 3 rd party insurance.
Thanks in advance for all the answers and I know that most CD's are on the beaches of Ontario this weekend and so the earliest that I can expect some answers from Guru's might be on Monday.

It might be better to visit a doctor in 24 hrs ... even in an emergency to show for later that you visited a doctor ........... might also be worthy to call one of those 'we can help you in accident claims regardless of your fault .. call us before you call the insurance ... we charge our fee only after claim being discharged ' people .... I keep on hearing 'Sukh Dhaliwal' over the radio .... a simple talk does not carry an obligation I guess .
Since you have a police report , you don't need to visit the collision center I guess .

I will not comment on the claim for medical benefits since its a moral issue for me, but for your car you need to do the following :
Go to the nearest collision reporting center, file your report, get a number and report that to your insurance company. They will advice you further action and suggest you take the car to thier recommended garages for estimate. The garage will send the estimate directly to Insurance company and the company will approve/disapprove based on the quote. You can either accept that or take it to another garage. If you are aggressive enough, you can choose your garage and as long as it is a standard quality garage, they will accept the quote and work done there. You can even request for a rental car during the period of repairs.
Even with 3rd party coverage, if you are not at fault, you can get full coverage for the cost of your damages(I think without any deduction, not sure-you have to confirm that with your appraiser or case agent).

According to ON law: "If an insured person sustains an impairment as a result of an accident, the insurer shall pay for reasonable and necessary expenses incurred by the following persons as a result of the accident in visiting the insured person during his or her treatment or recovery"
If you are finding any health issues resulted from this MVA, including emotional problems... plz contact a good rehab centre who can help you with all the health issues that OHIP don't cover. Recently, one of my family member involved in an accident, eventually developed depression and driving/passenger phobia got well helped through a rehabilitation group at Yonge & Eglinton in Toronto (they have Tamil speaking Psychologist as well). I don't want to put their advt here, so if needed - PM me for details.
My advice (learned from helping her is) NEVER EVER go to paralegals... they can mess your case; rather find a good lawyer if decide to sue the insurance
