Where to notorize Power of Attorney?

Hi CD's,

I need to get notarized a Power of Attorney in favour of my brother for using it in India.

Shall it be done by Indian Embassy or the regular Notary Public?

Please also let me know if personal visit to Indian Embassy is required or the document could be sent by post.

For some documents it is o.k. to get them notarized by a Notary Public. It will also call for a signature verification. For some other, such as Bank Loans and Property Transfers, currently some of them and a few of the sellers, DEMAND that you have it done by the IHC and also for your own safety, it is good to get it done by the Indian High Commission.

It is done within a few hours. For that you can visit them in person and spend a few hours there. There is a small charge for each page for the attestation. ($50.00).

But they are fussy about the way they accept the monies. So, carry all of your Cheque books and all of the Bank books too and see which Banks are close by. You may have to use their services, to comply with their request. Make sure you have your Passport and a second Photo ID. And a copy for your files.

I have personally sent my notarized POA for attestation to the Indian Consulate in Toronto at least 5 times, with all the required documents ( verification of the notary, photocopies, etc). Each time it has been returned without the job being done. One time they even attested the wrong document and sent it back to me. I have already wasted hundreds of dollars to send the documents via Expresspost. The only other option I now have left is going to Toronto myself. Oh, I am not from ON and unfortunately fall under CGI toronto. My suggestion to you is to go personally and make sure you look over your documents multiple times. There is no saying what reason they may refuse to do it for.

To Make a POA, I did the following :
--
1. Got Notarized. Made sure there is page numbering and both my and the Notary's signature is in all pages
--
2. Got it endorsed thru Official Document Services (I think, this is the counterpart of India's Registrar of Assurance Services). Takes 15-20 min at their office

3. Went to Cgi-Toronto and got it endorsed.
Take photocopies of the document, passport and cash. Only 1 window is available for service - the rest 2-3 for show only (ie., closed). It took me 1/2 a day for a simple job but atleast got it done. They ask you to come later and pick it up.

Maybe this particular rule may vary from one Indian state to another. In my case, I made it so that my brother can sell the property (we both are stakeholders). As per the new stupid rule, an apartment (in a multi-storied building) can be sold using the POA document but not the land (in case of a house).

Does it mean that a POA can not be issued for the sale of a house in India?

My father is planning to give me a POA to sell property in India. Any idea how long the process takes to register the POA in India?
