We just relocated to Canada from USA and have some questions regarding applying for my wife's PR.
I am a Canadian citizen and my wife is an Indian citizen; I was married/divorced before(never applied for her PR) and now I am married to my current wife for the past 6 yrs and we have 2 boys together. I want to submit her spousal PR application.
1) if we should apply from within Canada or apply from India? Which one is faster as her tourist visa expires Aug 2010 and we have a wedding in July for which we plan to go to Australia. We were told that doing it from India is fastest(2 months), but than she might be called for an Interview. Also, has anyone processed from within Canada and how long did it take?
2) we were living in USA for the past 6 yrs so have no Canadian salary, and now I am an independent contractor, will that be an issue?
3) We have already applied for the boys citizenship last year September, and it's under process, do I put them on the spousal application again?
4) Do we need to get her medical and police clearance done before submitting the application? We had done the police clearance in USA back in June 2005 (as we originally planned to apply back than, but never got around to it). Will it still be valid?? She has been living in USA for the past 11 years.

You apply from with in. See how it gets bounced around. It ultimately will have to go to the Indian Continent for all of the clearance, Medicals, PCC etc, where it will get resolved. When all of this gets done, you all will have to cross the border and get the PR issue settled.
1) You are here, that is what counts. Which is faster? If you can stay here, then who cares how long it will take?! You please wait for their response. ( from others )
2) You are a Canadian Citizen. They are looking at your bank balance. You gave them the details when they let you in. The criteria are slightly different so, take advantage of it.
3) Getting into Canada and getting Citizenship are two balls of wool of different colors. First you apply to get in. Then you apply for the citizenship. Now you know which came first, the egg or the chicken.
4) You will need to complete the whole process for all of them when it calls for. So, get your self ready for these, starting now. PCC has to be updated for the wife and it calls for 'from each of the places resided', one from the local or the State Police and the other from the FBI. Indian High Commission will give you one from India for the Indian end.. It has to be fresh and it has to be with in six months of their asking. Since you are already here, you can get the past records updated by them for all of the places that you lived, from places, prior to arrival here. There is a six month time of stay requirements, for each place. If you lived in those places less than that then you can skip them.
If you had applied and gotten through with all of these, you would have completed all of the formalities prior to their arrival. This looks like you guys were in a hurry uprooting yourselves from the US end.
Now you know why I started with the heading that you were fortunate....
