Need advise on PR in last stage of processing

Hello Guys,

I had applied for PR while working in Canada and my file almost got complete and had received a letter from "Canadian Consulate general NewYork " asking me to send passports to NY Canadian Consulate General for PR visa stamping.

But due to my campany internal transfer , i had moved from Canada to India in Dec'09 and not informed to consulate as of now assuming that i will be coming back to canada in a month. But due to some problem, i am still in India.

In this case , requesting you to advice me on following.

I) In the letter that i received from Canadian Consulate General NY , it is clearly mentioned that passports will be returned to Canada / USA / Bermuda only.

Since i can't come to Canada due to my current company policies , can i send the passports to NewYork from India ?

II) If i send , can they send the passports to India as a special case ?

III) If they don't entertain to send the passports to Indian address in any case, can i ask them to send to my cousin's Canada address (with my authorization note) so that he will be coming to india inperson and handovering to me?

IV) One of passport requirement that mentioned in the letter is " Passport must be valid for atleast 1 year". Where as my passport is going to expire in 11 months which is short falling 1 month for above condition. Hence i applied for passport extension in Tatkal and still waiting for new passport.

But they had given only 60 days time to send the passports for PR stamping which i am going to cross soon. In this case , can i send my old passport which is short falling for 1 month ? Did they consider it for stamping though it is short fall of 1 month ?

V) Indian passport office put a stamp in my old passport when i submited the passport renewal application and returned the old passport to me. In this case, if i didnot get my new passport in a week where i am going to cross the 60 days deadline , Can i send my old passport to them ? Do they accept it ?

I) They can only mail them to these locations. That is the area that they are able to send to. a) You can send it to Canada and then send them from there to NY. (Please see if they all have the 12 month validity first.)

II) I cannot answer that question. But they surely can send them back to Canada. Make sure that the postal authorization is issued to the one who collects....**

III) YES you can. That is the best solution that I can see here.

iV) YES Tatkal system should speed up your receipt of the passports early.
a) so don't spare the expenses. Use the COURIER Services through out and make sure that the Passports reach safely to all of the destinations. (There might not courier if they come to know that they are Passports, so be informed.)

V) Please do not use any canceled Passports for any PR Status. You will be defeating the current purpose. Currently records do show the canceled ones as no good ones. How do they know? who cares you do now.

Thanks you very much for your quick help. Sorry to bother you but i forgot to ask few questions in my earlier thread. Could you please guide me on following.

As per your earlier advise , i will mostly follow step III as you feel it is most appropriate as per my current situation. but i would like to communicate few more things which i am thinking as per my knowledge.

1.Can i personally visit New York embassy and request for PR staming as i have a valid US visiting visa currently (as a special case , though it is given that \"Submissions of passports are only accepted by mail. Passports are returned by mail within 30 business days. This does not include mailing time under website \"http://www.canadainternational.gc.ca/new_york/imm/general_info-rens_generaux.aspx?lang=eng&menu_id=206&menu=L\" ).

if your advise is yes , I am planning to say to Visa officer that \" I will be in Canada for next 4 weeks only as per my current employment here and need to go back to India to report to my office in India, hence i can't send the passports through courier now as it usually takes 30 business days. Hence i came personally today , pls advise on my situation\".


2. if yes, since my spouse is not having US visiting visa, can i go alone by carrying her passport along with her authorization?

3. if they don't entertain in receving passports personally by hand , can i go to Canada from New York using my current employer's provided Visa and workpermit which is valid till May end. So that once i go to Canada, i can courier my family passports to New York.

4. if yes for above, is it not illegal to use my current employers provided Visa and workpermit for my self use with out their attention?

5. if it is not a problem, is there any way that my employer had cancelled my workpermit with out my notice?

6. If it is a problem to use my employers provided visa and WP , and i decided to follow your advise given in earlier thread which is III , Do i need to inform to Consulate that i had been in India for 3 months due to my company internal transfer ( as i was not informed till now assuming i will be going back soon) ? If i informed to them now, is it causes any problems to current file status?

7. Or Can i simply send my passports to my friend in canada and ask him to send to canada with out attaching any letter stating about my current stay in India and ask them to send the passports to my friend address in Canada ? ( and i will give Post authorization to my friend).

Please advise.

1) They do not accept your submission in person, reason being, they want to track incoming PP's and corresponding out going mails also.

2) That option is your choice. Beware of the risks, you carrying someone else's Passport and separation of an individual from it.

3) YOU ARE CORRECT. The Visa provided to you is not conditional, you can also travel with it, as long as it has not expired. That looks to be the best option available.

4) Why is it illegal, could you brief us or you find it unethical for some reason?

5) You are still employed with them, So, I do not think so. But the Visa is still valid is it not? Does it have multiple entry in it?

6) Your Passports and the stampings there in tell them all of what you are asking here. So, they do know and understand the current situation. There will not be any problems to your status here in Canada. They have determined your qualifications to be suitable and you can be admitted. (unless you are suspecting otherwise)

7) That is the alternative. That is the cheapest and the best. But be aware of the risks of sending the Passports out of the country and loosing them!! { you still have the job and you can enjoy your well deserved holidays with the family and keep a cool mind and let it not play games with your subconscious.(*ence.} When they come back to you STAMPED for entry, make a trip with the family to Canada and return back. That trip will be well worth the efforts.

I suggest Best course is to use the mailing address of ur relative in canada.

As Per my knowledge, when i go to Canada using my employer's provided visa , they will be asking me to show the \" salary letter and Deputation letter from employer\" to issue the work permit at the time of port of entry ( Immigration check ).
Since i had already received workpermit in the past and still it is valid till may end, i can show to them and enter into canada.
But my problem here is , workpermit indicates that i am going to work at my client location once i had been admitted to canada using my WP which i am really not.
I am still employer of my current company which is located in India but not in Canada since they already sent me back to India through internal transfer. Hence pls advise whether i can use my employer provided workpermit ( not the visa) to enter into canada though i am not going to work there .

You are "a very smart man McGee". now take it easy and send the PP's to your friend in Canada and let him do the needful for you at this end. See if it works. If you want, you can provide them a letter that will say that you are on a visit to India and want to make the trip with the COPR, the next time.
