Hey guys,

Here is a minor situation here, I hope it doesn't gets worse:

PR Issue date -- 31 March, 2005
Initial stay ------04 April, 2005
Returned --------11 March, 2008
Left to India------12 March, 2008
Came back Canada---27 March, 2008
Visited US---------27 May 2009
Came back Canada----- 3 June, 2009
Visit US------------23 October 2009
Came back to Canada --- 27 October 2009
Visit US-------------02 April 2010
Came back to Canada---04 April 2010

Now I am applying for renewal of PR card, my questions are:

1. As per the rule for living 2yrs out of 5yrs, I am short 2-3 days, if the period they consider is 31 March, 2005 to 30 March, 2010. Will this period be considered or the date that I am applying be considered.
2. All the trips to US were personal.
3. Would the days leaving and arriving in Canada (Date Left and Date Arrived) be counted as "IN CANADA" days, if so then I can still satisfy the rule even if they consider the 5yrs period as mentioned above in question 1.
4. I applied for my wife in 2008 and she is here too and we have a kid as well.
5. How is the five year period counted?

Appreciate your response, Please reply guys..I am holding onto the application for now...
BTW the PR card they issued me was valid until 15th April, 2 weeks beyond the regular 5yr period...

I am just copying your dates. I did not add or calculate the qualifying days required. BUT when you fill in the application form for the renewal of your PR Card, and add up you will get the EXACT count as noted there in.

Since you went out and returned on the days mentioned above and had no problems, I am sure there will be no headaches in obtaining your renewals also.

Currently it takes well over 60 days for the renewal. So hang in there till it appears at the Mississauga center and you get a request to drop in and pick the same up. (Or to a location close to where you hang your hat.)

Now get a few good pictures for the PR card and then go to the website and apply and also pay the fees required. You will have the guide with instructions to follow there in. Comply with them.

The minute you land here, you are in Canada. The five year period is counted from the date of entry stamped in the reverse side of the PR card. The exact date will be a date it is good for, is ONE day before the expiry of the five years from the date stamped there in. Both days inclusive. A leap year will give you an EXTRA day.

Thanks a ton Freddie, I don't understand when you said that the "exact date will be a date it is good for, is One day before the expiry of the five years from the date stamped there in." My PR Card was valid till the 15th April, 2010. Does that mean my 5yrs period will be from 31 March 2005 to 15th April, 2010.

When I spoke to one of the agents at CIC they said that the 5yr period is counted backwards from the date you sign the application for PR Renewal, but you say that the 5yr period is from the date you land.

Also, would there be additional scrutiny since I am applying after my PR card has expired?

All the trips to U.S were by road, I had no issues with entry into Canada.

I have seen people ignoring some Road trips to make it count towards residency requirement. This is because PR cards are rarely swiped at the border unlike international flights..

I would suggest try and remember which US entry does not have a entry stamp on the passport and also ur PR was not swiped.. ignore it from the list.

Let me go a little slowly.....

From your first posting, you say that the PR Issue date is 31st of March 2005. Your FIVE Years finish ONE day before, which is the 30th of March of 2010. Both days inclusive. Please see the reverse side of your PR Card for the details. Date of entry is different from the date of validity. That does not mean it is no good. Hey, you are smart enough to count FIVE Years and I am sure you know how. See how your mind plays game some times and you want it in your favour. But you are lucky. And....

I am not splitting HAIRS here.

The other days that you are quoting are for some one to sit down and add and tally it for you. YOU can do that yourself. HOW? Just go the website and fill out the application and start to count each and every day that you think it counts in your favour. The total should be 365 X 2 = 730 days in total. If you have them, then you are sure to get your renewal. If I were the I/O, then I will let you have the days that you went across the border too, on a shopping spree. How is that for assurance.

If you land in Canada at 11:59 PM on any day, then that day is counted too. So you be the judge in the timing, I have no knowledge of your timings and dates.

I might not have paid any attention to your statement that your wife and child are here too. Good for you. And, I am happy too.

I hope you got it. OR Now, it is as clear as MUD, am I correct?

The reason I mentioned about my wife and kid is that, would there be any bearing on their status if they deny my PR. May this sounds too stupid, but I am really worried about my renewal..

From 27th March 2008 to 26th of March 2010 is two full years. The number of days that you were on holidays is nine days. Because the day you were in Canada is counted here in your favour. You get credit for those days here. You did have five days in when you landed here first. So adding those will give you sufficient number of days. That should be o.k.

After reading your comments from CIC, they seem to be using a rolling five year period. If that is so, then your date of renewal in May will give you all the days needed.

As DWC says completely omit the trips you made to the US, as they are not logged in you PP. So, just quote the date of return from India and and the current date of renewal to get your NEW PR Card. After they call go and pick it up.

The rest is O.K.
