Traffic violation tickets

Hi desis,

I was drving in scarborough and while taking a right turn with green signal on, i did not give right indicator signal in my car. The police stopped me.


It is the first time it happened to me and i immediately got out of my car and went towards police. The police rudely told me to go back to my seat and take the position.

To my knowledge it is not an offence to get out of the car and approach police to enquire. He further told me that whenever they stop me i should not come out of my drivers seat. I never read such thing in the traffic rules book. Is there any such rule? And if so why such rule? I was some what upset by the police behaviour.

Secondly the police asked me to show drivers licence, vehicle registration and insurance paper. I took out from my purse both G1 and G2 and showed him. He asked me why i show two licences, isaid it is G1 and G2. He said i supposed to discard G1 once G2 is recd. He returned to me only G2 and did not return G1. Is the police authorised to hold my G1 ? Also i told him i did not bring vehicle registration and insurance paper. All were recorded by the police and they issued three tickets.

1) For not signalling right turn on green signal.

2) For failing to show insurance paper.

3) For failing to show vehicle registration in my name. ( I am the ownwer of the vehcle.

The police told me i have 15 days to use any of the options indicated in the ticket.

What is best option i can use in order not to pay fine and demerit points. What way i can fight it out in the court?

It's a traffic VIOLATION, not violence as your subject line states.

I don't know if it there is a rule stating you need to stay int he car when stopped. It doesn't matter what the rule is. The police will see it as a threat against them if you approach them. Therefore, they will order you to get in the car. The general etiquette is to stay put in the car, turn the radios off, remove your sun glasses and place both your hands on the steering wheel. This will help the police understand you mean no harm. Mind you, they don't know who or what's in the car when they stop people.

All the three tickets are legitimate tickets. You are required to carry license, proof of insurance and registration. As the officer stated, you are allowed to exercise your options within 15 days. If you decide to contest, you should go to the court and could set an appointment with a prosecutor. During the appointment day, you might be able to remove violation regarding insurance and registration by proving you have always had those two even before you received the ticket. Also, as a first offense, they might remove the points and reduce the fine amount for the turn signal violation.

He was one grumpy police officer. You should not step out of car if police stops you. You could have got shot. Your traffic violations are minor and it is likely to be dropped as I do not think police officer will come on date for such minor violations. Do not pay fine and fight for the ticket.

There is always first time in Canada. Thank god you did not give him $20 bribe. There are lot of discussion on this. Search on charcha.

Do not come out of car when police stops you. They can forcefully arrest and handcuff you before asking a single question. They take no chance that anyone can hurt him/her. Once they indicate to pull over, just safely pull your vehicle to right side and wait for officer to approach you. Turn the engine off and putt hazard lights "ON". Do not relese your seat belt or open windows. Don't try to search for papers in glovebox and under seats he/she may get impression of you are searching a weapon. He may order you to raise hand and come out of car. Some times police stops you and waits for few minutes then comes to you. When he/she stops you he feeds your licence plate in his computer to check available info of vehicle/owner/lic plate validity and criminal history of driver. Then he/she relays radio message for either back up requires or not and informs control room that he /she is proceeding with a so & so vehicle. If there is doubt or suspision criminal history driver, officer requests for backup and aproachs stopped car with a radio ON.

* You must fight the tickets if you have valid ownership & insurance copy. Must take those with you to the court. If you see JP and try to resolve with point saving and paying a little amount, ticket still will be in your record for a few years. First and second tkt will be ignored by JP because you will prove with documents. Third if you plea guilty with explenation it will haunt you for some time. So take a chance and ask for court date, you have brighter chances that officer won't appear because likely that you will win with providing documents. Even he shows up, you can request the judge to save points and reduce fines.

Thanks for the inputs guys. I decided to fight it out in the court.

But i fail to understand onething. When the police has caught some one for a small traffic violation, why should they think that the person in the car will start using weapons against police ? If the police catches the driver for some big offence like robbery, murder etc then i can understand the reason why they should think in that way.

It looks to me highly idiotic on the part of police when they behave like this to a normal man who did a small traffic offence. Leave big thieves and catch small fish and provoke !

The police is stopping you for a probable cause which is a traffic violation. They don't know if you are the perfect gentleman or a wanted murderer. They don't know if you have flowers for your wife or a gun for the one that irritates you. They simply don't know that. All they know is they have a pulled over a perfect stranger for the probable cause. Hence, they have every right to be cautious.

Anyway, if I were you, I would choose my battles. No sense getting provoked by a traffic stop.

I was somewhat upset at that particular ocaasion but then when i analysed, the result is this :

Probably they are seeing mostly thieves and not a common man in when they pull over a car in canada. Crime to the maximum where i am living in. This is what i can guess.

May be the people here already are used to this and take it normal. For me it is abnormal.
