If someone is working thru an agency on a contract position, when are they eligible for stat holiday pay ? I looked up ministry of labor website and it says, does not matter how many days u ve worked thru agency, u should get paid...consultant says u need to work 30 days prior to stat holiday...anyone has any experience / info ? thanks.
When I was in Canada, 9 months back, the rules said that you need to be paid stat pay even if working through an agency.
Donot know how it is now.
Seniors, Please advise.

As a contractor I don't think you get paid for statutory holidays . No work , no pay for contractors unless specified else in the contract .... Talking about hourly contracting that is ....
Ashu - can you post a link to the website you are referring to ?

Fido.
The rules should be in Employment standard act - Ministry of labour - Ontario.
If Ashu is billing to agency on an invoice then Ashu will not be eligible for statutory holiday pay. (as said by FIDO) But if Ashu is filling in time sheet and getting paid by agency for hours alongwith 4% pay then Ashu will be eligible for holiday pay. If not sure, you can ask Ministry of labour and they will reply promptly.

Yup.
Desi # 1 is right.
Remember that for IT jobs, you generally are a contractor.
For all other jobs (incl. finance), you are sent for work by an Agency. You submit your timesheet the agency and the agency will pay a payslip similar to a company employer i.e. taxes, cpp, ei will be deducted and you will be paid stat. pay.
If Aashu is working through an agency and her/his payslip is after stnadard tax, cpp,ei deduction, then he/she is eligible for stat. pay.
