Spouse sponsership

Hi All,

I got engaged in April 2011 and while applying for a study permit I cud not declare that i am engaged as there was no option mentioned for it and thus came in Canada on study permit in August 2011.Since I got an opportunity to study in one of the best colleges I withdrew from my college in September itself. Now I will be studying in winter session starting in Jan 2012.


1- We got married in Nov 2011, and soon plan to file an application for sponsership. I would like to know that should we declare that we did a proper engagement ceremony in back home with the consent of our parents.


2) Since I'm on study permit would it mean to the immigration officer that I used study permit as a option to be in Canada?Please suggest what should we do and what is the best option so that the risk factors are reduced.

Looking forward for some valuable suggestions/information.

SimpleGirl: From what i understand, it is marriage between two individuals that is official recognized. Engagement means nothing as far as recognition is concerned.

Meaning, If you are engaged before and not declared in sponsorship documents, then i believe you are okay.

But, if you are married before but not declared in your sponsorship application then you might be in a bit of spot.

I know few friends who are/were in similiar situation.

Thank you Rajagopal. I really appreciate your timely reply. As you mentioned that some of your friends are were in same situation so can you share your knowledge with us on how the filed their application and the result or the success rate. There are few more things things that are in my mind.

1- Can my husband file my application directly from Buffalo as the processing time there is less as compared to that in Canada.

2-If we don't declare our engagement and then present our case that I came in Canada and then met my husband here would be more convincing to the Visa Officer, Keeping in mind that my current status is International student permit which is valid for 1 year.

you can file in buffalo for spousal VISA only if you are US citizen .

I am assuming you are INDIAN Citizen so you have two options :
1) Apply within CANADA ( which takes couple of years ).
2) Apply from INDIA ( which is around 6 months normally )

so you decide which route you want to take .

also you can check on cic.gc.ca about your options .

SimpleGirl: My friends applied from USA since they were living in US before. They admitted everything to the Immigration authorities without hiding anything which is the best way to go about. :)

Your case maybe be different as suggested by Sant due to the nature of your Indian Citizenship status.

I would say apply from inside Canada since both of you will be together even if it takes 5 long years.
