Employer denies relieving letter !

Hi,

We are in a very bizzare situation and need your advice.

My wife landed in saskatoon 2 months ago for SINP then PR. She had to work for 960 hours and then file for SINP. After working for 6-7 weeks she realized that her employer has never done SINP or work permit or PR for anybody before. Also the employer is extremely lousy and takes months to provide pay slips and that too hand written which would not help us.

So she decided to look for a diff employer and got one .. the joining is 3 weeks from now. She told her employer that she wd quit but serve a long notice period to help her find a replacement.

To this the employer (Iraqi) shouted at her and said she will not provide her with any relieving letter. My wife def needs a letter which tells the number of hours worked and the start and end date as it will go in the SINP application along with the next employers letter. My wife worked very hard and the employer was happy with her and also gave a raise.

IF the employer does not give her the letter we lose 2 months and we cant afford that as we will have to start again and the rules have just changed from May 1 and now u need to work 1920 hours instead of 960 hours and her visa expires 31st dec. We cant afford this at all.

PLS TELL US HOW CAN WE GET THE RELIEVING LETTER FROM THE EMPLOYER IF AFTER REPEATED PLEADING SHE DENIES IT. my wife clicked pics of cheques and paid tax.my wife is away from me for 2 years fighting for PR alone in canada. she moved from toronto to stoon. now at this stage if anything happens we would break.

If the salary was paid by cheque and tax deducted, then it must have been reported to CRA and she can easily get a copy of the ROE (record of employment) from local employment office. This is no doomsday situation, please ask your wife to stay normal and execute her duties in a professional way. Contact the nearest local employment bureau and talk to the agent regarding how to request a copy of ROE. Keep bank statements as proof of income.

Got a call from my wife and now the employer says write whatever you want on a piece of paper and bring it to me and I will stamp it. thats all.

DISGUSTING. How can a business owner behave like this on canadian soil ? wd the govt accept that white piece of paper of course not. It has to be on a company letter head.

I dont want to sound racist but I told my wife many a times to work for a white canadian only.

I hope the govt accepts the letter provided by the CRA in lieu of the employers letter as advised by Hiren Sir !

From the OP it sounds that he paid her as a contractor and hence not ROE (Record of Employment). When you get salary as a contractor, the local HRDC may not be able to help you.
