What kind of diplomatic immunity a Canadian citizenship provides while working in India, could you please provide details?

Unless cocaine use, rape or Murder is involved, As a Canadian I canot be put in jail and I will have access to consular officials.
So If they ill treat me any more or try to frame me, I will use my right as a Canadian and contact consular authorities to take me out of the country.

You do now know the full story.
There are no deadlines in the company and I am the one of the few to make my own deadlines and deliver.
We have consultants to do all job and need to moniotor only. I try to push the consultants to deliver a good product in time where as others do not and leave it to the whim of the consultants.
What pisses me off is that every one is on FB all the time. every one is job hunting at office time too to see if some one will offer better benefits. One individual is doing P. Hd. at office time. He is listening to lectures (using headphones). The situation is very leathal that I myself have lost interest in work. However to justify my high salary, I still want to work hard and give at least 51% of hard work. (In Canada, I used to give between 80% to 95 % of hard work).

All people are travelling. I travelled just 2 or 3 times. Other people visit China, Oman,London etc.. frequently. They claim the max. allowance allowed.

I follow John Tory's principle that when his (PC) party sent him to India to study Indians there, he paid for his own food (though he was entitled to party funds for food). His logic was that anyway, he has to eat whether he was in India or Canada. In Canada, he ate paying from his own pocket and so he followed the same in India.

I never billed my food expenses unless it was part of the hotel pacakge. I always stayed at hotels that I would have stayed if I paid from own pocket.

The saying " When in Rome..." canot be used here. Do you guys want to me draw a hefty salary but then be on FB,Shaadi, You tube, chat unnecessarily during office time, take sick leave when you are bored etc,... No sir.. I canot be like that.

Welcome back Timon.

It is human nature that if we have something, we don't realize the important of it and when we don't have, we are missing it.

Both country has its own good and bad. It is up to us to make up our mind. It is easy to keep changing decision.

Anyone moving back to India, I'll suggest you to note down negative points of Canada (from your perspective) and why do you want to move back to India before moving back. Note down all these points in detail as much as you can. Keep list of those points easily accessible in India. Read these points whenever you face any problem in India and realize that Canada was better.

Same applies who are moving back to Canada. List down all negative point of India (from your perspective) and keep easily accessible to you in Canada.

I belive the list will definitely help you to make up your mind and taking good decision of moving back to India/Canada.

Also, 1 year time is not enough for settling in India after spending few years in North America. I'll say before moving back to Canada, we should at least spend 2 years in India and give us a chance to settle down.

I understand, but you got to choose what you want. Here you were unhappy that you had to slog, there you are unhappy that you have too much of free time? Some of your previous posts showed off the enjoyment you were getting out of life there. Suddenly what changed? You want to give your 51% give it nobody stops you there but when you try to meddle other's lives without fully understanding the background, you are going to get $h8 in return. (oh well..I am partially doing that now).

Anyhow, the post is of Timon coming back, so welcome again Timon, whenever you get chance, do update the post with overall settling over here and a quick brief on the whole ordeal of decision to go back and then return here.

Diplomatic immunity is for certain foreign officials and diplomats living in host country's soil. They could shoot somebody and technically the host country cannot arrest them. Powerful countries have sometimes vetoed this immunity.

What TK is referring to is "consular access", ie., Canadian consulate steps in on your behalf in case you are in legal trouble or incarcerated.

It depends on how good a country's relationship is with India(or how forceful and how much of go-getters the cosular employees are) in order to get better terms for its citizens.

According to GOI, you are eligible for consular services if are a foreign citizen. Additionally, if you are foreign citizen with PIO status, you are still eligible for consular access.

They will plead on your behalf to reduce or avoid incarceration time, check if arrest procedures have been followed, bail matters, ensure your human rights are not violated etc etc. It can also be used for child custody matters, missing persons, etc.

However if you are a foreign citizen on OCI status, then the GoI has said it will disallow consular access. This was disputed on occasions and its legal/consular status was in limbo. US has been very insistent on providing consular access to its citizens irrespective of their PIO status.

At least this is what I read in Indian media two-three years back. Don't know what is GOI's current position on this. IMO, GoI diktat supersedes others on consular access to OCI Canadians.

Sorry !
I confused diplomatic immunity with consular access.
Error regretted. I am an OCI. Donot know if this will complicate things but my employer knows that I am an OCI and they have a copy of my OCI on file. We are employing atleast 5 foreigners (4 american and 1 canadian) in a small team of 15. However most of our consultants are foreigners from USA,UAE, China etc..
