UCCB/CCTB excess payment asked to be debited-Family in India

Hello!
This is for one of my friends who came back to India from Guelph permanently in 2011 May.

The family did not close their bank account when they left Canada but left a $50 balance. However they wrote to the CRA/CCTB/UCCB that they are permanently moving out of Canada. They told CCTB/UCCB to stop the payments from May 2011 but looks like they did not and money was being credited to the spouse bank account

The spouse received CCTB and UCCB (Children tax benefits) from 2011 till 2012. They filed for income tax for the year 2011 but there was no reply from the CRA. Their income was such that they were supposed to get around $ 4000 in refund for that year (2011).

However a month back they received communication that they must refund CCTB and UCCB as they were over paid or paid by mistake. The sum is around $ 2234 to be paid back. However as per the family’s claim, the CRA cleverly did not acknowledge the income tax filing where there was supposed to be a hefty refund but instead wanted the CCTB and UCCB back for overpayment.

Anyways, the family wants to sort out the tax issues and hence requests the following information:

1. They will try to access the bank account online to check the outstanding balance but they are not sure of the password. After 3 wrong attempts, the bank may ban the online access and the only way would be to contact the home branch to sort out the issue. Will they entertain phone calls from India without physical precense in India ? The family had the cheque books of the home branch. What would CD’s suggest? The family wants to pay back the CCTB/UCCB overpayments from the money that must have been credited to the bank account but not from their own pocket.

2. What to do about the CRA income tax return. It was paper filed and the family has no photo copies made. Also they donot have the My account access of CRA.

3. The family has no plans of returning to Canada at all, though they are Canadian citizens. However they are going to apply for Australia immigration next month? Will this situation have an effect on the application.

Since you say that they received a letter from CRA informing them about the overpayment, it is apparent that they know where he is currently.

Once you wind down your affairs here in Canada, there is no way that they know where you landed or where you reside. So, this is one of the methods that they use to find your street address. But they have left a trail with a return address and so they do know where the hell your friends are now.

Now they are hijacking the I.T. Refund till they get their Over Payments that inadvertently made into the Bank A/C.

Don't forget that the CRA, Immigration, CCTB are all operated through one SIN number and through ONE Computer of theirs. So, your friend is stuck with them and unless they have given a LOCAL address of a friend of theirs for their REFUND Cheque, they will hang on to the sum till he reimburses the monies owed.

Now ask your friend a simple question, which is..: If you leave CANADA Permanently, how can you leave a fricking Bank account open with FIFTY Bucks in it?? That will CRUCIFY them FOR EVER and a day. SO, ask the Bank to send the last bit of money in there with them and close that account and provide them with a NIL Statement and an International Money Order (IMO) and collect the whole lot of money that they have in there with them. That will be the smartest move that they would have done to SEVER from Canada. (The banks cannot reverse the transaction for them).

With that letter in hand, and with a copy to CRA, and with a cheque for the CCTB received since their departure in their open bank account and then ask them to send the CRA Refund cheque for the sum of $4,000.00 to their current address in India. Make sure that they provide them with a cross reference to their CCTB account/SIN Number and the demand letter with a copy of the 'IT Return page' of the tax year 2011. This will make sure that they know why you are making a demand. (Not you---- But your friend and his family.) (Ask them to rework the same from the book where in they will find a second copy, since you say that they have no photocopy.)

Please tell them to PHOTOCOPY all of the correspondence from now on in duplicate and leave an extra copy for the wifey. This is for the future.

Will this situation have any effect on their Immigration to AZ. Naw, they are free to go and settle anywhere they want, if they get a better job. Good Luck to them.
Also they don't owe any money to anyone, it is the other way around. So, get a chuduvellam, or a kuppi from them.

Your information was very informative and educative.
I asked the family why they left the $ 50 in the bank account and they told me that, they were expecting some refund cheques / CCTB for that month and they had assumed that they will access the bank account online in a month and write a cheque for the amount in it as well as intimate the bank to close the account (Before they left Canada, they talked to a tell;er in the bank who told them that to write a letter to the manager to close the account) but after they came to India, priorities changed and they never bothered to access the account online and now they forgot the password.
Anyways, their mistake.

Password resets for online banking can be done over the phone. I doubt the branch will be able to assist you with that one. As long as you can reach the 1-800 number for the bank over the phone (which I don't see why not), you should be able to get the password reset done.

Why did your friend wait so long for the refund / Notice of Assessment. It's funny that only when CRA asks for the CTB to be returned they realize that their refund hasn't been processed. Again call up CRA and ask for the status of the refund. In all probability they'll say that they haven't received the return and ask you to mail it again. Do not delay in returning the CTB while waiting for the refund. They could very well start charging interest. Also ensure that CRA is not charging interest for the CTB they've already credited. It was their (CRA's) fault, as long as you can prove it that you informed them.

I don't see any reason why it should affect the Australian immigration process.

Thanks and an update.
My friend was able to log on to the bank account. It just asked him a couple of multiple choice questions (like what was your street in 2006) etc...
The balance in the bank was $ 2103 Vs. $ 2234 that is to be paid.
The CRA never credited the 2011 refund.
I sent mine by Speed post and he also did send his by speed post but looks like it got lost.
Will try to contact the CRA for the same.
