Hello all,

Me and my husband along with our son got Canadian PR in Sept. 2008 and we landed in Canada in June 2009, stayed for 1 wk and then went back to India. My daughter was born in March 2009 in India and as our PR processing was completed by that time we haven't mentioned it to CIC. Our agent told us to tell about our daughter at the time of landing.

When we landed here in June 2009, the biggest mistake I did was -- for a question in the landing document - do u hv any dependents apart from the listed above- I ticked No and signed. For some reason I was thinking totally different and thought the question was about any other dependents other than my son WHO IS ALONG WITH ME AT THAT TIME. I don't even know why I thought like that. May be jetlog or dealng with my 3 yr son, I couldn't think properly.

However, when talking with the Immigartion officer, when he asked me do u have only one child, I said I have a daughter as well who is only 3 months and in India. He looked confused and his first languauge is not english and he called another immigration officer. I explained again to him. The second one said thats fine and sent us. We haven't thought of asking them do I need to add my daughter on the landing document. As they said to go we thought that might be fine.

Now we came for good to Canada last year and and applied for our daughter's sponsorship in last May. After 9 months of processing we received a letter from CHC in New Delhi, mentioning that we haven't declared our daughter any where while landing or to CHC and so they can't issue her PR and we have 30 days to appeal on this.

We have been waiting since 9 months for her PR and now we got this. For god sake she is our daugher. I don't know wht else I can say. Deeply sadened.

If that immigration officer told us to add it on landing documents I would have done that and it would have been a simple case. Now it looks like it is getting complicated. As I don't have any thing in written that I told the immigration officer I can't prove it.

Some one said we need to go through a lawyer now.

Please can any one guide us what to do and if u know any one who has gone through this horrible situation.

Sorry to know about your situation. It is not easy but at the same time it is possible to sort it out. You need to appeal through a lawyer. Send all supporting documents like birth certificate etc and be ready to go for a DNA test.

You can come out of this situation one day .... but it takes lot of time times if you are not lucky

At this point you need to deal with CHC only.

Make an affidavit under oath and state only the facts that helps your case. Include supporting documents and submit your appeal.

With due regards, you made a declaration on a very important immigration document that there were no more dependants. You signed that document. Blaming the immigration officials is not correct.

See it from the point of view of Immigration Canada - the timeline does not match - you declared that you have no other dependants and there was no mention of another child anywhere.

Seems a difficult case and you will need the help of a lawyer. There are many child trafficking cases especially related to adoption. You will need to prove that you made an error and that she is your own daughter. Maybe your doctor records of pregnancy, delivery records, proving beyond doubt that she is your own daughter.

I would suggest that you approach this in the right spirit. Don't blame or be the victim. You made a serious mistake. Be humble, apologetic and prove your point. Hope that helps.

Hi all,

My daughter's sponsorship is refused by CHC New Delhi and the reason they said is I haven't declared her in the landing document. Which I did by misunderstanding the statement in the landing document. I sent all the relavent evidences through the lawyer before they made the decission. But no use. The letter says we can appeal.

Can someone please guide us how to proceed now. This is a very big thing which will decide whether we will stay in Canada or go back to India. There is no point in us staying away from our daughter. I know I did a mistake but it is truly by mistake and I did mentioned to the officer that I have a daughter but nothing written. What can I do now. Every problem has a solution and is this a solution less problem. I don't know.

Please help us and any suggestion is highly appreciated.
