Hi dear CD members..appreciate your insight

Did our landing in April 2009, and therefore the PR is valid until April 2014. We have only been physically present in Canada for a total time of around 2-3 months, currently living in the gulf. The last time we visited Canada in 2012, a remark was put on our passports and in our file in the system (which we got a lawyer to request for comments) saying that we have been out of the country since May 2009 and run the risk of losing residency privileges.

My husband and I are planning to cut off our ties from Dubai a relocate by the end of the year. Obviously we have not completed our residency requirements by a long shot, however, the lawyer is seemingly confident that there will not be any major issue while entering (especially if it is via the US border by road) and even if there is an issue, we will be allowed in and can file an appeal against any removal order which can go on for 2-3 years by which time residency can be established.

So my question is - from your experience/knowledge, what are the chances of a removal order NOT being placed in my circumstance. And based on what has happened so far, incase it is placed, will it be easy to contest and worth the effort. Basically the end has to justify the means...

Do not worry.
There will not be any removal order.
When you enter .... if they ask ... you tell at the immigration that now you have fixed all your outside obligations / issues and moved permanently.
Every thing goes into the system now a days and you need to prepare the base for the future defense (if necessary).

Hi Ads7484,

My parents are in the same situation as you are. They landed in Canada in 2009 April and stayed for 2 months and went back. Their PR card is valid till 2014 April. So even I am getting worried about POE and whether they will be allowed or not. I have sent you a PM, can we talk about it.

Just check what will happen to health card and SIN, without these being valid will it be worthwhile living here.

I have already done the research on that. Once you are inside Canada and there were no problems during your entry, then you will get Health Card and SIN card for sure. These are province based. So even if I had moved from Alberta to Ontario , I still have to apply for these two. So I don't think there is any problem in getting these two. I got my health card 2 years after I landed canada because I went back to India. I got my health card without any problems.

hey guys..thanks for your replies!

btw we already have valid health card and sin..which was all done in 2009 itself at the time of landing..my concern is having further problems at the time of re-entry (especially since it will be very obvious that entry is done close to PR card expiry time)

BCT Gurram..is it just that simple, that they will overlook the 'rule' and allow to stay on, even if we just confirm that the outside obligations have been taken care of and they want to stay permanenetly? I understand that there will be a lengthy litigation process (appeals filed etc) and in this time 2 years will pass..but any idea of the average cost involved for all this and the success rate?

again, my primary concern is to leave everything and go to Canada and then be faced with continuous issues regarding residency etc. Appreciate your feedback!!
