Australia says it will reveal new laws stripping citizenship from dual nationals engaged in terrorism.

The government said it wanted to ensure that militants with dual nationality who were fighting overseas could not return to Australia.

The laws would also strip citizenship from dual nationals who engaged in terrorism inside Australia.

The government said changes to the Australian Citizenship Act would be introduced to parliament on Wednesday.

The new laws could be applied to up to half of the 120 Australians fighting in the Middle East with Islamic State (IS), said Prime Minister Tony Abbott.

Supporting militants

"The legislation will update the Australian Citizenship Act 2007 to ensure dual nationals who serve or fight for terrorist groups, or engage in terrorism-related conduct inspired by terrorists groups, automatically lose their Australian citizenship," Mr Abbott said in a statement released on Tuesday.

"The Act will also be amended to ensure dual nationals who are convicted of specified terrorism-related offences automatically lose their Australian citizenship," he said.

Last month, the government said it would give the immigration minister the power to revoke citizenship in regards to terrorism activities but that option was attacked as unconstitutional by many legal experts.

Mr Abbott said on Monday the new laws would not leave anyone stateless and did not exclude the role of the courts.

"This will enable a person who has lost his or her citizenship to seek legal redress," Mr Abbott said.

Retrospectively

"If you are convicted of a terrorist offence, again, there will be an assumption that your Australian citizenship is forfeited, should you be a dual national."

Parliament's Joint Standing Committee on Intelligence and Security will examine whether the law should be allowed to operate retrospectively.

"Given that we have a number of dual citizens currently in jail after terrorist convictions, the committee should consider whether it should have retrospective operation at least in those cases," said Mr Abbott.

He said another review would consider what to do with people engaged in terrorism who were solely Australian nationals.

Seeing how Australia and Canada are similar while Canada aims to replicate Aus in most of the Immigration and Citizenship laws, very soon you will have it introduced here as well.

On the face of it - it is looks good, however like it is famously said - the devil is in the detail and the possible complications :

1. The decision rests with Minister in charge of citizenship and/or the court. We know how politicians decisions are 'fair'...

2. This applies to dual citizens.

3. The Canadian law also applies to citizenship acquired through naturalization. In effect we now have 2 level of citizenship and most of CDs are second class citizens now.

4. I don't know how this will work - but after renouncing your original citizenship, is the country of birth compelled to give you citizenship again if your CAN citizenship is revoked? Assuming one is convicted a terrorist and was originally from India, would Indian Govt be obliged to re-confer the citizenship on the terrorist and provide him/her an Indian passport?

It is very easy to be swayed by emotions - but when it come to implementation - legal and humanitarian considerations complicate the issue. Laws should not be framed this way.

Looks like this law not only applies to the terrorism sympathizers but the regular Officials as well. Here's the fallout of this law in Australia. Basically, if one holds a dual nationality and speaks against the Govt. institutions being in the capacity of a Whistleblower could lose the citizenship. Scary:

Wow! Shit is hitting the fan earlier than anticipated. This is what happens when we make laws that are extreme backed by emotions.

It will not be too long until someone petitions the constitutionality of this law. When PR and Citizenship was granted, the applicants were not made aware of this. To apply this rule retrospectively to all naturalized and dual citizens is breach of trust.

These parts of Islam which promotes non tolerance of other religions / sects and promotes violence is a global issue and threatens the society and the world ...

I hope there's an improvement coming somewhere in these parts of the religion else it looks like a senseless , bottomless well.

Having said that , I do not criticize / denounce all of Islam / Muslims - esp the ones who lead a regular normal life like us ... I have some friends in them & I do enjoy the Khans movies !!

I am certain if these violence / intolerance inciting parts are cleaned of the religion , world would be more peaceful.
