Hi,

Somebody recently told me that there is a law in Canada that the size of apartment one rents is linked to one's family size. It goes like this - If you have a 2 kids, both daughters, then minimum you need a 2bhk, one bedroom for you and spouse and one for both daughters. If you have 2 kids, one daughter and one son, then min. you need a 3bhk, one bedroom for you and spouse, one each for daughter and son. Could somebody please advise me whether this is true or was I incorrectly informed. HELP.

The apartment size is not linked to the family size. The law is for children above the age of 12 and of different sex. Differenct sex children above the age of 12 cannot live in the same room. So if one has 3 daughters and 2 sons, the legal requirement still is a minimum of 3 bedrooms - one for parents, another for girls above 12 and yet another for boys above 12. However, if all of them are below 12, which can sometimes be the case (as was in my family), then they can live in 2 bedrooms.

are you guys kidding me???

i am skeptical there is a *law* about this... it may be common sense, but a law???

also, even if there was, how would you go around enforcing it? you cant force someone to do that... if a family of four people all want to sleep in the same room because thats all they can afford, how can the government force you to do otherwise???

besides, for obvious reasons it makes sense to seperate children of the opposite sex, and even seperate parents of the opposite sex from the children for that matter, but i dont think, unless there is evidence of abuse, this can be done through regulation...

i did a quick search on both google and ontario e-laws and couldnt find any reference to this... let me know if i overlooked it...

amit/chandresh... i have been vainly searching for any reference to this... i called up alberta child welfare services and they told me nothing of the sort exists in alberta... they usually dont care as long as there is no abuse involved...

infact the only reference i was able to find is a vauge bylaw passed by the city of chicago in the early 1900's that mandated something of the sort, but that explicitly dealt with incest...

which to me makes sense... if such a law did exist, it would probably be thrown out on appeal as violating the canadian charter of rights and freedoms against discrimination of the poor... in my mind, you should not be able to legislate to a poor single mother on welfare that she has to provide something of this sort...

do you guys know this law exists for a fact, or is this something you guys have overheard? if you know of it, could you please provide some sort of reference? this thing has really perked my curiosity, as you guys are the second time i am hearing of such a law...

i could be looking in the wrong places... so any links i would be very grateful for...

I have not read this 'law' anywhere, but I know I was denied entry in two apartment buildings based on the fact that I have a son and a daughter and the management of these buildings told me that since they did not have any 3 bedroom apt vacant, by law they could accept me as a tenant.

However, I had the same questions asa you have Bighead with my friends and they said that they had similar experience. Infact two of my friends got into the apartments by saying that the husband does not live in the country and the wife will share the room with the daughter and son will occupy the other room.

However, I will try to find out more about it. But may be Amit knows it for sure since he is a real estate agent.
