I was caught driving 70 km on a 50 km road on Dec/22 2003.I rquested the police constable to allow me to have a look in laser gun thru which he was monitoring the speed but he did not allow.He said that since this was my first time,they will reduce it to 65km and I will be saved from 3 demerit points.I appealed against this and went to the court on 23 sep 2004.I did not take the help of any lawyer.In the court they offered me out of court settlement but I did not agree.My point was that I was not driving at 70.I should be charged for only the speed at which I was driving.The trial was held.I had nothing to prove that I was innocent.The judge believed the police constable technician when he said that his reading was correct AND THE LASER GUN PERFECT.The constable did not produce any record to show me that I was driving at 70.Finally I got convicted and paid fine and also got 3 demerit points.Today I filed an appeal AGAINST THIS JUDGEMENT.Can anyone advise whether I stand any chance or How can I go about fighting the case.I am sure I was not at 70 but I have nothing to prove that.How long these demerit points r valid and how long the conviction remains on record?Can anyone suggest the line of action I need to take.I want to fight it out.How can I prove that I was not at 70.Regards
Sorry to hear your situtation. I have a neighbour on my street who is a traffic cop. We once talked about whether or not they have to show us the radar gun. He said that people wrongfully asume that in Ontario the cop has to show them anything. They don't have to show anything. Also he said that the lazar radar is condidered 99.99999999999999999% accurate. He suggested in these type of case (ie lazar radar) take whatever lower charge you are offerd

Thanks ravi for your reply.I am grateful to u you for sparing your time.I know I am sunk but I am still making a try to fight because I know I was not at the speed for which I am being charged.I have already lost it but I appealed it again last week because I want to drive home the point in that constables mind that he has not charged me for the correct overspeeding.
You may have momentarily hit 70, or your speedometer is reporting too low.
Many vehicles have some sort of error in their speedometer readings.
That's why they don't ticket at 110 if the speed limit is 120.
