We applied for skilled class immi. from usa(buffalo) last year jan 2003.. received our medicals in july 2004 - submitted em in sept 2004.. the lawyer told us that he has now applied for the interview waiver... the thing is dat my husband cant visit usa due to some immi. reasons but i can.. well, we had a talk with our uncle whos a consultant.. we told him dat we have submitted our meds.. he asked us if yr interview has been waived or not.. we told him our lawyer has now applied for it..
very rudely he told us dat yu guys wont be able to get the immigration.. he said yu guys shud have waited first for the interview to be waived and than wud have got the medical done n submitted.. he said it says in the medical letter that if yu r applying for interview to be waived the process is to first apply for the interview waiver and than get the medicals done... im pretty disappointed to hear this and just praying to god... hoping everythings going to be fine soon..
I donno wat to do now.. who to beleive - our lawyer or my uncle..
p.s: is there anyway we cud fnd out if the immigration ppl have received the medicals or not..

Your uncle is wrong. If the embassy asked you to do medicals, then you did the right thing.
Medical is not the major factor for Interview waiver. When you chose to apply through Buffalo, your lawyer should have advised you about the possibility of being called to an interview in the USA and the risks, especially if you did not have a US visa at the time of application.
Interview waiver depends on a series of factors. Your lawyer seems to be doing the right thing.

The thing is dat i do have a valid visitor visa.. Lawyer told us that if for some reason they want to take an interivew i cud go on behalf of my husband.. and we can request them to do phone conference.. so i ll be present physically for the interview and hubby on the phone.. donno if its possible or not.. but this is wat he told us..
Our uncle gave us a number of a lawyer whos here in to.. hubby spoke to him and explained him all the details.. he said i take 3000 to 4000 for such cases but im gonna charge 7000 for yr case..
Sorry i have no one to talk to.. hubby gets mad if i try to discuss all this with him.. lawyer is not always there wen i call him.. i was too shy to ask the question here.. but yeah i did it may god bless yu all..
