Move from USA to Canada

Hi,

We (myself and my wife) landed in Canada from USA as immigrant 18 months back. We stayed there few weeks and got our PR Cards, SIN Cards, opened the bank account and then we came back to USA. I am working in Detroit, USA for past five years on H1B visa.

Few things have changed since our landing in Windsor, Canada.
• My wife got new passport as she applied for the change in her married name (she also has the old passport where Canadian Immigrant Visa is stamped, but her PR Card carries her old name as in old passport)
• We have twin kids who were born in USA last year.

I would appreciate your sincere advice in learning the following:
1. Can we move to Windsor, Canada after the above mentioned time delay and changes?
2. What the possible problems, we may face?
3. Can we transfer our commodities, like Sofa, Bed, TV and other household things?

Yes, I think you are still within the allowed time frame for staying out of Canada.
You haven't lost the PR status yet, so you can move back easily.
Make sure you carry your PR cards and both the old and the new passports.
However, I remember that Canadian immigration at the airport does not ask for passport if you have PR card.

Your kids will not be Canadian PRs.
They are US citizens so they can come with you to Canada, but they will not be PRs.
Once you re-settle in Canada, you can sponsor them for PR.

If those goods were not included in your original goods to follow list, then you cannot bring them for free.
You can of course bring them, but you will have to pay duty on some of the items, like TV, DVD player, cameras etc.

How should I plan the moving from Detroit to Windsor?

Should I call at Detroit Windsor tunnel and let them know that I am coming with my commodities.

I once imported my car in Canada while landing but did not registered it in Canada. Can I bring this car again in Canada while it is registered in USA.

I don't think that is necessary.
Once you get there, tell them all you have and the values of the items.
They will assess duty then.

Yes, you can - but with a caveat.
When you say you imported this car, do you mean that you have done the RIV formalities, but you haven't registered it in Canada yet?
That may be a problem because RIV gives you a certain number of days after the import procedure is complete to register your car.
Once the safety inspection is complete, they give you a certificate which is valid for 60 days (or maybe 30, I forget) and you must register your car within that time frame.

If you did that procedure 18 months back, when you first came to Canada, that deadline is long gone.

I am not sure what is the next course of action - you should call the MTO office in the province you are planning to go to (in your case, Ontario) and ask them.
Tell them what you have and what you did and ask them what you should do next.

You don't want to run the risk of having your car impounded once you enter Canada, so make sure you get very clear instructions from them.

Hello Anurag,
Did you move to Windsor?
I am in a similar situation and planning to go back to Canada from US. I would appreciate if you (or anyone with similar situation) can share your experience regarding the move. Your suggestions (the dos & donts) are required to plan this.
