Hello Mr. Massood,

I am a PR and just got married in Canada. My wife is living in Canada as a claimant refugee, she came from US 2 years ago with her parents and claimed asylum. I would really appreciate if you can answer few of my questions. I would like to sponsor her as soon as possible. My questions are:

1. Does she have to withdraw her refugee claim and leave Canada before I apply for sponsorship?

2. If yes to question 1. Will her withdrawal effect her parent's claim?

3. Her passport is with the Refugee Board and has expired. Can I still submit the application with a copy of her expired passport?

4. I understand that if I apply in Humanitarian & Compassionate basis it may take 2-3 years. How much time will it take for overseas application. My wife is from Pakistan.

I would really appreciate if you can answer the above questions and also I did not find a good lawyer who would be willing to take this case. Would you be interested? Please advice.

1. She can withdraw her claim. She doesn't have to leave right away. She can leave when her time [as per CIC] is up. She'll most probably be called for an interview.

2. If the basis of their claim is similar, it will have some negative effect.

3. You can but she'll need valid passport to travel.

4. You may not sponsor her from within Canada since she is a refugee claimant. You can only go the 'overseas' route. Pakistan may take 5-8 months.

5) We are always interested in new clients. ... but first you have to determine whether we are good lawyers.
