I became a permanent resident on February 5, 2004. I returned back to United Arab Emirates after 7 days of stay in Toronto. I got the SIN card and PR card is not received, i am aware that l needed to travel with a travel document to Canada. i presume i can be away from Canada until February 12, 2007 without losing my permanent residence status. However i am planning to settle in canada for ever from September 2006.
I am worried about the residency requirement check at Canada airports as i am absent from canada for a long period (almost 2 1/2 years).
If the immigration officer screening me say no to my entry to canada using his decretive power (if any) how to convince him that i deserve to be a permanent resident.
As i am coming there after resigning my good job and disposing my properties I am very much worried
you can return to canada before expiry of three years period from the date of first landing. so the deadline is feb4.2007.since you are planning to return in sept.2006 . there is absolutely no problem.
however since you are not having pr card you have to apply for travel document. and once you get travel document there is absolutely no problem to travel by that date. because while issuing travel document if the visa officer is satisfied that you hold you pr status then the decesion taken by him is final and immigration officer while entering in canada will not ascertain your pr status again. so nothing to worry .

you say that you did not recieve your PR card? When we entered canada last december there was a person who had come to Canada and had not waited for his PR card before returning back. The immigration department did not let him back in. they said he would need a VISA ( the one they give you at the time of immigration. But that is valid for 1 year. so if that is expired and you dont have a PR CARD then you might be in trouble. I would go to the canadian embassy and talk to them.

if a person has not pr card then he have to apply for travel document . the high commission will issue travel document if a person have comply residency requirement. when entering in canada if a person have travel document then absolutely there is no problem

On which airport it happened? He was from which country? He really had to go back by the next flight itself? I presume that he was having a travel document, as no airline will board him with out a travel document. Or he was travelling by car and it happened at the US-Canada border?

You'll be alright. If anything happens, the Officer will allow you in with conditions and you can then consult an immigration lawyer to deal with this. I don't foresee any problem, whatsoever.
