You canot be presecuted for breaking Indian laws in Nepal since Nepal is not a part of India. On a sidenote, Many sri lankan fled to Europe and the americas by using a similar technique. From Sri Lanka they will fly to Manila (which does not need a visa for SL citizens). From Manila, they will exchange boarding pass with a Canadian in Manila who would take the SL's return boarding pass. Due to massive influx of refugee's fleeing SL by this way, Manila Immigration has plugged this loophole, a long time back. TK A
